I'm in the same boat as you fiona-scotland, i've just received my statements and there are a load of "SC" cahrges starting at £10 in mar01 through the £15 charge, then onto the £25 charges. All in all its not as much as i thought it would be but it'll still be better in my pocket than the banks (hopefully);)0 -

Hi all,
I have been going through the reclaiming process since December.
I asked for list of charges, they took 3 weeks to say it would cost £10
I then sent the £10 and they exceeded the 40 day rule so I sent letter to them as a compliant and a follow up. The y eventually sent me 5 years worth of statements.
I then sent 1st letter stating I wanted charges back, they replied thta the charges were fair.
2nd letter stating I would take it to court if they did not refund me, no answer.
Went online and printed off documents and filled them out and took them to sheriff court, staff VERY helpful and told me I had to detail my case more. Went home copied every statement and made my case. Took it back and paid my £39 to court. I received notification from court and a date I could call them to see if bank was going to defend themselves.
This time came and I called court..... they were going to defend it!!
I was due to go to court this Friday... BUT yesterday I received a letter from bank for full amount plus my court fees!!
They did not admit fault but stated...
I am of ther view that the bank has a valid defence to the action you have raised. However, it is simply uneconimical for the bank to proceed to a hearing and for this reason only I enclose a cheque for £xxx.00 in full and final settlement of your claim. This is made of of the sum sued of £xxx.oo, your court expenses of £39.00 and interest of £xx.00
A copy of this letter will be lodged with the court to show that your claim has been settled in full

I wrote to the Clydesdale Bank in February to ask for my copy statements - £10 enclosed!! It took a lot of telephone calls but eventually in the third week of JUNE I got the statements. When I added everything up the charges have come to more than £4,400 so I sent off Martin's letter 2 - recorded delivery and called them up 10 days later to make sure that they had received the paperwork and that I would hear back from them within the 14 days. I was more or less laughed at by the man at the bank who said that they are receiving more than 250 letters a day and they had 40 days to reply to us and not 14 days.
In between times of waiting for my statements, I called the Financial Ombudsman to help me and they did. At first the bank wrote back and said they would not accept my complaint, the ombudsman wrote to them again and they wrote back saying that they would reopen my complaint. I received a letter from the ombudsman at the end of June to say that the Clydesdale Bank have agreed to repay all "penalty" fees - what does that mean!!!!!!
Anyway, in my conversation with the bank the man eventually listened to me and looked on the system and low and behold there was my case. He said that they ordered a cheque for £2165 for both accounts. The request was made on 15 June but they dont issue cheques after 20 June for a week and so it should be sent out by the first week in July!!!
What do I do - it is nothing like the figure I was looking for and I dont want to loose out on the money but it is a lot of money.
He also told me that I was unable to claim for overdraft interest which I have not but I have claimed for sc period charges which hopefully is ok.

Finally received my statements today, no letter apologising for delay or anything just a bundle and blank piece of paper with ref number on in very small print. I have now done 2nd stage with interest added and have it already to be posted of tomorrow. I have calculated my claims with the Sc and irregular fees on statements so just hope that that is ok. Will wait and see what tactics they use now.0

evening folks, i'm new here, please excuse me if theres a thread on this subject already. basically i wrote to clydesdale, well, sent a standard letter, asking for all of my bank statements over the past 6 years, blah blah blah, and i got a reply saying "during this time, the relationship between you and the bank was governed by the banks standard terms and conditions" and then listed a load of stuff. in short, they didnt send my statements, :mad: and i'm wondering if its a lost cause fighting it, or should i send another letter? many thanks xx0

As you can see from the above posts you really need to push the Clydesdale to get your statements/information. Its not a lost cause fighting this but they won't make it easy for you, have a read of the success stories and they will give you hope!0

Has anyone had any luck with the Clydesdale bank? they have played along up til now, but this morning I got a long letter basically saying that they ARE entitled to the charges and that I knew about the charges because they are listed in "terms and condition" not sure what to do now, it seems like they have the upper hand now. Can anyone help please?

Has anyone got any ideas of what I can do now that the Clydesdale have sent me a letter today basically saying that they are entitled to make the charges and that its up to me how I run my account, I was really gutted to get this, and don,t see that they are going to pay. Is it worth going on to the next step?

In May I started a claim against the Clydesdale through the FOS for my statements and charges to be refunded. I had the standard reply from Cldesdale on the 16th May we are investigating. Yesterday was the 8 weeks up so I phoned the FOS they said send in the complaint form but may be worth phoning the bank first. I phoned the Leeds Advice Quality Unit who sent original letter. 0113 2315010They were suprised I had not had a final responce so looked into it. Firstly they cannot find me on the system re my bank statements but they say they having dificulty with closed a/c and might not be able to access them !!!!! RUBISH this has be 4 months now. But here is the best bit then she piped up you got sent 2 letters on the 18th May in seperate envelopes. One saying we will try to get your statements (yet I am now not on the system) and the one a final responce saying no refund of charges as per the T&C's blah blah. She said BOTH letters must have been lost in post!! The have now closed the case as I did not reply promptly. I stated I was sending my form back to FOS as IMO they have deliberatly waisted 8 weeks. Then she adviced to speed things up forget the FOS and send a responce letter to Clydesdale, like I am going to do that. I have insisted on a copy of the missing letters. Phoned the FOS back who were great and said they will still pursue but they did not sound suprised at this new tactic. Unfortunatley the FOS said it will take about 6 months.So every body keep phoning them up to check progress and leep a note of the dates, times and person you speak to in Leeds especialy if using the FOS.Fire up the Quattro!0
