I would wait for sure rather than pay a solicitor. If you decided to down the court route with a solicitor it would probably take longer anyway than waiting on the FO.

Yes I have also had success with financial ombudsman - claimed £1584.10 including interest - received cheque in March for £742.75 with the usual proviso etc and did accept it but only as part payment and sent all the rest of the bumff to the financial ombudsman office - they replied last week saying bank being contacted - letter from bank to-day dated18/5 saying they had a letter dated 30/4 from FO and enclosing a cheque for £742.75 again so paid altogether £1485.50 and I am such a happy bunny - the letter is written without predjudice etc - please all do not give up and give the FO a try - they are wonderful as is this site - good luck all who follow. We will beat the beggers!
Saving in my terramundi pot £2, £1 and 50p just for me! :j

I was told today by the Advice Quality Unit of the Clydesdale Bank that they won't be posting out details of my bank charges until the middle of June at the earliest; the delay being that the original company they were using to actually process this information weren't up to scratch so they ditched them in favour of another.

I began my claim at the end of February, received a letter at the start of April essentially asking for more time to process details of my charges but have heard nothing since leading me to contact the information commissioner.

Am I right in anticipating that they won't be able to do anything to speed up the Clydesdale?

They still have to stay within the 40 days regardless of their logistics problems. Having said that it may be worth reporting them to the Information Commissioner if only for the annoyance factor. In reality it most likely won't speed things up. This is happening with all the banks due to the sheer number of claimants.
Hamsters have no tact and diplomacy, nor do they want any.

    Many thanks for the help.

I've already reported them to the IC but was just trying to assertain the likelihood of their being able to speed things up.

Understandbly they too must be inundated with similar requests.

    Cheers
  • hello, can anyone help please?

I sent off £10 to Clydesdale Bank on 21st March requesting bank statements.

On 1st May, they sent me a letter stating that "due to volume of requests"
they are not yet able to supply me with the information requested.

The 40 days have well and truly gone, so can anyone help me with what I should do now? Am I right in reporting them to the Information Commissioner?

If so, how do I do this,or is there anything else I should be doing?

I sent them a letter back on 7th May stating that was going to inform the Information Commissioner about their breach, but I don't know what to do,

    anyone help please?

And don't forget that there is only one IC. However, if he doesn't get all the complaints, he won't get an accurate measure of the problem. And only he could make the banks and CCCs do something about it. Until then, especially as they know what all this info' is going to be used for, there is every reason for them not to.

PS. It could be that Clydesdale have a particular problem. Firstly, they aren't the world's biggest bank. Secondly, they have had a case, where the claimant put in multiple claims of £750 each (the small claims limit in Scotland). One claim was upheld, but all the others were dismissed on the grounds of abuse of the system. I strongly suspect that the publicity about this case may have awakened other customers to their charges and encouraged them to claim as well. You know what us Scots are like about money!

Your best bet is to sit on your local branch doorstep and keep phoning but as you can see Clydesdale have been extremely slow in sending out statements/info for a long time so I don't see what a new company has to do with it.

By all means report to the ICO but has they are inundated with similar complaints they are sending these out to the banks in monthly batches.

Someone will pop this up to the Reclaim Bank Charges board for you and I'll merge it in with the Clydesdale Bank thread .

You can report to the ICO but to be honest they are so busy they are only sending out the complaints in monthly batches to the banks so it isn't a speedy process.

My advice to you is go to your local branch and basically sit on their doorstep until you get the statements you need and/or call HO and Customer Services daily.
