    superb to hear that victory was yours ploppy.......

    I am at the stage where I am realising that court cation is the only way forward. I sent my 1st letter off on the 20th of Feb. I got the usual reply.....I've been phoning Leeds constantly...or I was, I called yesterday and realised that they are all talking crap. it's all stall tactics and lies. I put the phone down and called the "Customer relations manager".....phone lines were engaged, I called reception, couldnt put me through....so.....I called every number close to the one I had and got through to a few people.....eventuall I struck gold, I got the "Customer excellence" person.......so, I cleared my throat and let rip.......in no time at all I was chatting away with a customer relations manager. I told him that I wanted to make an official complaint against the leeds office and gave him the details. I received a call back and was advised that they were running behind...blah!...blah!....2 weeks....blah!.......so I told them that the answer was not satisfactory and I would take it to the Information Commisioners office......filled in the paper work this morning...............

    I am owed an absolute fortune, I will not be put off by any underhand tactics the bank use. I am owed money and I will get the money. I closed my account with them as they made incorrect charges on my account. It took me 9 months to get an apology and the "black mark on my credit" removed.

    I have also been looking in to court action in England although I am in Scotland.....its a bit of a grey area and I think it can be done.......Id appreciate anyone elses comments on it though.....it appears its a judges decision more than anything.

    Im about at the same stage as you, my original letter went out on the 6th February. Iv'e phoned and sent more and more letters, I sent an e mail to a link to do with the court I got from a thread further back, but they recon because its above £1500 I need to go and get professional help. As I live in Scotland too, I just filled out a form to the ombudsman and sent all corriespondance to them last week, so Im just waiting to hear back from them. As the court thing sounds to be difficult in Scotland.


    How much is your claim for, and have you got an address to send things to in England, do you just make out you moved there or what??

    ME: 14th Dec 06 1st letter requesting statements
    BANK: 6th Feb 07 Recieved statements
    ME: 7th Feb 06 2nd Letter sent to request money back £4124.22
    BANK: 16th Feb 06 Letter from Clydesdale Bank saying 'No' and advising
    me about my aggreed Terms and Conditions.
    ME: 19th Feb 06 3rd Letter sent request money or I'll go to court
    BANK: 7th March 07 Letter from bank "Reopening Complaint"
    ME: 23rd March 07 I phoned bank to see whats happening
    they say"There is a cheque for £400 getting sent" I told
    them to that I don't want it, im going further
    ME: 4th April 07 4th Letter without predjuice offering to accept less BANK: 5th April 07 Letter from bank "Advising that there 8 week period
    had lapsed and they need more time"
    ME: 13th April 07 I phoned bank to see whats happening,
    they said "They have back log and won't be getting back
    to me for another 2 - 3 weeks
    ME: 14th April 07 I sent letter with all corriespondance to Ombudsman.

    Are you still waiting for your statements, and if so, how long ago did you send for them?

    Initial letter 16th Feb 2007 - request 6 years statements

    1st written reply 16th March 2007 - acknowledge request etc :rolleyes:

    2nd written reply 11th April 2007 - sorry too busy come back later :mad:

    3rd written reply 12th April 2007 - sorry too busy come back later :eek:

    didn't get round to phoning today, have to be Monday. But to say I'm ready to blow after reading the above few posts would be an understatement :angry:

    hi there, ive just had to send off another letter asking for my statements to the clydesdale bank, the 40 days was up on thursday but i did get a letter sayin i would get them in due course! seems to me from the comments posted that they like to take the **** out of there customers, they seem to forget that their customers pay there wages!
    will keep u updadted bout this, im finding this quite stressful but im refusing to give up!
  • I sent my letter requesting refund of my charges on the 12 April 07, and received the basic letter from them saying my charges were fair and was given their complaint proceedure leaflet, spoke to my partner who works for a bank and he advised this is just trying to scare me, i am not put off with this letter and i am sending my 3rd letter advising i will be taking them to court if they dont pay up.

    They may need more time to look into this, but do they give you time to pay bank charges, NO they whip it off your account the day it happens, its about time we stand up to these Banks before they help to make us bankrupt

    Hello everybody ive sent second letter to Yorkshire Bank from my first account waiting for a reply they have another 7days then i will pursue them to find out whats happening.Ive just sent my first letter for statements on my second account both with Yorkshire Bank im detemined to go all the way i cant see really how Yorkshire Bank can get away with not paying out when they read all these threads they must be thinking they are winning because they havent paid out well now its time for more Yorkshire Bank customers to jump on the band wagon and show them we will not be beaten.

    After reading this forum I am even more certain to go straight to court from step3 instead of giving them warning.

    The respone I got from clydesdale at step 3 was standard referral to their complaints procedure. Is it possible their response is probably to do with less volume of folk being persistent with refund requests as compared to England?

    I'm hoping to have this sent to the court by end of week. I cant wait.

    I've also got a similar set of letters to write for my sister. But once she gets her bank statements through I'm very tempted not to even write a claim letter to Clydesdale and go straight to court with that too.

    phoned today and guess what, I was told they are on order and may take up to another 2-3 weeks. last information was false. told aqu in constant in constant touch with info commisioner. assured that no delaying tactics being used, just volume of work causing a backlog. 1,000s of complaints/requests being received on a daily basis and the system is doing it's best to answer them all in good time. reminded I have the right to contact the I.C. if I wish but it won't get my statements any quicker. what a crock of !!!! (pardon the french) but it was as frustrating a phonecall as I've made to date. the guy (brian) was, according to him, only there to field the huge number of calls they're getting and was polite all the way through the call. how can you rant at someone who isn't the cause of the problem. guess I'll take up his offer to contact the I.C. and see what happens. meanwhile I wait, and wait, and................maybe wait?

    Well think clydesdale have had long enough to return statements so next letter saying 7days to comply will be sent of to them asap.

    Ive just recieved my reply from Yorkshire Bank from my second letter they have sent me a letter saying i knew about the charges and if i dont send in a complaint within 8weeks they will consider the matter closed has anybody else had the same letter and where do i go from here do i just send them a letter to say i will see them in court as they have told me if i dont agree with there decision i could complain to the Financial Ombudsman Service do i just skip him and go for my third letter.
