Evening folks,
I am looking for some clarity before I send off my first letter.
I intend to claim several charges back from Clydesdale Bank, however am concerned about timelimits.
The accounts I used may have now been more than 6 years ago. Is it still possible to reclaim?
I am not 100% sure if I can only claim if the account was within the last 6 years, or 6 years worth from any account. (I hope that makes sense)

If Clydesdale are being awkward with your claim, not answering letters, responding late, using delaying tactics like 'reopening a closed case' that was not closed in the first place (at least not to your satisfaction) then complain.
Your legally entitled claim is actually a request for a refund and not a complaint unless you specifically use the words complain or complaint in your letter.
Once you have established a complaint you are entitled to a copy of their complaints procedure which should include your entitlement to know the name of the person handling your complaint, a contact number for them and an agreed timescale to deal with the complaint (8 weeks by FSA Rules). So if they are messing you around demand this information and follow up any breaches of their own complaints procedure.
That should get them moving along if they are stalling or delaying and will actually cost them more money. As the newly created team in Leeds handling these claims will be seperate from their long established complaints team, by making a formal complaint a 2nd team has to get involved so costing the banks more resources.
I'll keep you posted how I get on with my claim when I get answers to the above post and believe it or not I used the standard letters so forgot to include complaint in it. The next letter will be tho

I have banked my cheque as partial settlement and written again to them saying I accept it as my money as partial settlement of unlawful charges and they can now speak to financial ombudsman as I have sent copies of every letter and communication from both sides to them with their complaint form. I dont see why we cannot cash our legal money and I have told them twice it is only accepted as a partial claim. Heres hoping it works.Saving in my terramundi pot £2, £1 and 50p just for me! :j0

Can someone help me please, I have sent all the stuff to the clydesdale bank and I'm now at the refund stage. I phoned to see that they have got my letter as its 14 days today. I was told that they have received the letter and they are sending out an acknowledgement letter and they then have 8 weeks to investigate.
Is that right ?

I posted out the following letter to Clydesdale on 26 February 2007 (recorded delivery)
I am writing to request a fully comprehensive list of all the default charges for direct debit, unauthorised overdrafts and standing orders I have paid over the last six years.
Please find enclosed a cheque for the maximum statutory charge of £10. If you are unable to provide this data, I will accept a copy of my statements going back six years; I understand that statements on their own are not covered by the Data Protection Act 1998, yet I’m not requesting the statements per se, but the charges, which I’m entitled to by law.
I look forward to your response within 40 days, as Clydesdale Bank is obliged to reply under the Data Protection Act. If not I shall seek remedy from the Information Commissioner.
I got a reply on 05 April 2007 (letter states)
Dear Ms Henderson
Re data protection act 1998 - data subject access request
I refer to our previous correspondence acknowledging receipt of your request for details of charges and/or statements relating to your bank account.
Within the terms of the data protection act 1998 we have 40 days in which to provide you with the information we hold. The end of this time period has almost been reached, however, due to the high volume of requests we have received in relation to this high profile issue, I regret that we are not yet able to provide you with the information requested.
Whilst you are within your rights to refer the matter to the information commissioner at the end of the 40 day period, I confirm that we shall provide you with the information as soon as we possibly can.
I thank you for your continued patience and understanding in this matter
CAN ANYONE ADVISE ME WHAT TO DO NEXT OR SHALL I JUST WAIT??
END OF 40 DAY PERIOD WAS 07 APRIL 2007

can someone please help me? i'm claiming charges back from CLYDESDALE BANK and after reading thru 6 years worth of statements i've discovered that they only take a " maintinence charge " when they feel like it....these vary from £8.50-£25.00!!!!!! and some months they dont take a penny! please help me as i'm hoping to claim back £3212 thank you in advance0
