Lorraine, thats fine to start your claim for the 6 years and if it comes to going to court then we worry about the 5 years at that point.
tricia9, if you have gone over the 6 year limit the bank will more than likely remove just those charges from your claim.0 -
I'm confused, I sent my original letters on the 16th. Feb., they were received in Glasgow on the 20th. After phoning Leeds, and getting a call back, I got written confirmation dated 16th. March. They state that within the terms of the Act they have 40 days in which to provide me with the information.
Question is, from which date do the 40 days start? The 16th Feb. (the date on my letter) or the 16th March (the date on theirs)?forever hopeful0 -
hi i sent my letters to the clydesdale bank telling them they owwed me £2100 inc interest they told me to get lost. then after the forth letter they sent me a letter inclosed with a cheque for half the amount without interest (£950). I then sent them a letter asking for the full amount minus 25% which would amount to (£1600). I have just recieved a letter back from them saying take it or leave it to the £950. what should i do as i have heard if i take them to court as i live in scotland i can only claim £750. and that clydesdale will tell the sheriff court tht i cannot claim them again after the first claim!!! plz help0

I had the same 50% cheque but I said in my letter I would only accept this as part payment and have not cashed it yet. I also sent a 14 day letter saying what I would accept less 25% without predjucice and if no reply or no satisfactory reply this week coming I will go to the ombudsman. It is not another claim - continuation of the first one I would say. I hoped they would cave it but............. They seem to be the worst to pay out from all the banks from what I have seen. I am claiming £1211 inc interest from Clydesdale on behalf of my partner.
Have sent 2nd letter to Leeds requesting refund but they have ignored my 14 day deadline and am now at day 18. (I need this weekend to make sure I get the next part right)
That figure is the last 6 years worth and it would drop by £184 plus interest if it was 5 years so I will continue with the 6 year claim total.
What I want to ask is the best way to proceed.
As they ignored my polite letter requesting a refund and the next one is the court letter, should I use the Scottish Sherif court with a Summary Cause, or as they are using the Leeds address pursue it thru the English courts?
I am English, my partner is Scottish and my parents are in London so if I pursued it thru the English courts using my parents address should I use a court as close to Scotland as possible (cut down on travel costs), the one in Leeds or the one in London? And would this be the best option
Or
If I go through the Scottish courts and use a Summary Cause to make a claim for over £750 would I have to drop the claim to 5 years myself and re-adjust the total before I file the claim or fill in the forms with the total above and let the court make the adjustment later if needed. Also does the 5 year date begin from the date of the first letter or the date of the court hearing ?

As you can tell from my name I work for the Pru and the Insurance companies like the banks are regulated by the Financial Services Authority. These companies have to have very strict guidelines in place regarding the handling of customer accounts and more specifically a complaints procedure that adheres to FSA guidelines.
If you feel Clydesdale (or any other bank) is being awkward, not responding on time or at all then read the following pdf. It has far more info than the generic purple Financial Ombudsmen Services (FOS) leaflet that is handed out by the banks.

If Clydesdale are being awkward with your claim, not answering letters, responding late, using delaying tactics like 'reopening a closed case' that was not closed in the first place (at least not to your satisfaction) then complain.
Your legally entitled claim is actually a request for a refund and not a complaint unless you specifically use the words complain or complaint in your letter.
Once you have established a complaint you are entitled to a copy of their complaints procedure which should include your entitlement to know the name of the person handling your complaint, a contact number for them and an agreed timescale to deal with the complaint (8 weeks by FSA Rules). So if they are messing you around demand this information and follow up any breaches of their own complaints procedure.
That should get them moving along if they are stalling or delaying and will actually cost them more money. As the newly created team in Leeds handling these claims will be seperate from their long established complaints team, by making a formal complaint a 2nd team has to get involved so costing the banks more resources.
I'll keep you posted how I get on with my claim when I get answers to the above post and believe it or not I used the standard letters so forgot to include complaint in it. The next letter will be tho

I acn't seem to find the first message I posted (yesterday). So here goes again. I have read through all the messages on this clydesdale thread and will post my first letter re: statements tomorrow. Please advise me if this is to go to Customer services in Waterloo St or to Leeds. I am aware that my claim has to go to Leeds, but don't know if they are dealing with statement requests as well. I sent my statement request (£10 enc.) to Waterloo St, but reply came from Leeds. So I would send any letters direct to there. You got the address?
