    Hi Just wondering how any of the people from befor that got cheque's sent to them offering them half of the claim back are getting on, some of them has says that they were banking the cheque but carrying on to get more??

    Hi Folks,

    I'm looking for some advice on default charges applied.

    I've noticed two charges every month for

    SO COM C/A SILVER Fee £7.50 (Probably Current Account Silver)
    DD Bankers Insurance £5.99

    As well as the usual "Irregular Fees"

    They charge this to my account every month.

    Do those two charges look like something I could apply to get back plus interest?

    Thanks in advance for any pointers

    Hi Rod,

    No you can't claim them charges back as they sound like a/c service charges.

    Hi there

    Just wondering if Edinburghlass can help me, I think i've been messed about alot, my original letter started way back on the 14th December, still never got anywhere, so I don't think anything is going to happen unless I take it further, Im just needing a bit of help.
    What do u do to start the court proceedings, do I need a solicitor?, do they send a letter to bank first? does this cost me anything? and can u start proceedings on line?

    Hope u can help with this?? ;)

    I am searching for advice re taking a Scottish case to court and wondered if you had any. My charges exceed £5000 before interest and it's Natwest. Any help would greatly appreciated. Thanks.

    Evening folks,

    I am looking for some clarity before I send off my first letter.

    I intend to claim several charges back from Clydesdale Bank, however am concerned about timelimits.

    The accounts I used may have now been more than 6 years ago. Is it still possible to reclaim?

    I am not 100% sure if I can only claim if the account was within the last 6 years, or 6 years worth from any account. (I hope that makes sense)

    Advice?

    A little unclear about the prob... You can claim charges made in the last 6 years! Hope this helps.
    Stick to YOUR timescale. Dont take ANY bull. DONT be intimidated. The law is on OUR side.

    You can claim charges back for six years from the time you found they were unlawful. I suppose you heard about the bank charge/credit card fees furore about the middle of 2006 - in which case you can claim fees back (no matter how old, but be reasonable) anytime you like until summer 2012.

    Your basis for claiming back fees older than six years would be under the Limitation Act 1980, either:

    s.32 (1)(b) of the Limitation Act 1980 on the grounds that you could not reasonably have discovered the bank's deliberate concealment of the facts relevant to your right of action before the report of the OFT was published in April 2006, or alternatively,

    s.32 (1)(c) of the Limitation Act 1980 on the grounds that the payments were conceded on the mistaken presumption that the said charges and interest thereon did not amount to penalties and that you could not reasonably have discovered the said mistakes before the OFT report was published.

    At the time these sums were debited, I assume you were under the mistaken belief that the bank was entitled under English Law to take that money. I'm sure that if you had known that the charges were penalties, you would not have paid those charges.

    In other words, there's no reason to stick to only the last six years.
