Take the £10 back as they have not delivered on time but also wait for your statements and claim like all of us Most of the banks are not closing accounts so your other account should be ok.

I have two bank accounts I am claiming charges from. I received a cheque last week with no details as to which account it related to. I sent it back with a letter on Monday saying thanks but no thanks. I gave them a settlement figure. I received a cheque today for the other account. They have seven days to reply or I will start court proceedings. Will hold on to this cheque and see what happens next.

SUSAN _ return the cheque to CB with a letter. CB are known for 'small print' that encashment of the cheque consitutes acceptance of F&F terms.

Exactly as mags has done :)

Thank you for your letter dated xx/xx/xx. I respectfully decline your offer of £xxxx.xx as settlement of my claim [and have included the cheque you supplied in respect of that offer.]

My claim is for £XXXX.XX as outlined in my Particulars of Claim, plus court costs of £XXX.XX, and this claim will continue until payment is made in full.

Alternatively, should you wish to settle my claim in full, then please forward the balance of the claim (£xxxx) without further conditions and I will inform the court that the claim is settled.

Thank you - I decided to send them a rec del letter to-day saying thanks but no thanks I have kept the cheque but will not cash it till they give me the rest of the money - I have sent a without predjudice letter to say will take slightly less than the full amount as their goodwill gesture if they pay up within 14 days and time was of the essence or I will be pursuing them via the ombudsman on that that date. Hopefully then it will be just short of my full amount IF they pay up then.

I have 2 accounts. Sent 2 letters and 2 cheques recorded delivery to Glasgow address (16/02/07). No reply but cheques were cashed (27/02/07). Phoned Leeds, no record of enquiry. Sent recorded delivery letter with details to Leeds (9/03/07). They phoned me (15/03/07) and refunded one charge, (seems it goes by the person, not the account, so X accounts = £10) Promise to get back to me ASAP with required statements. Very polite on phone, so no real complaints so far. I'll let you know of any offer/problem.
    forever hopeful :p

  • Yes, I have reclaimed £1000 from Yorkshire/Clydesdale bank!! Keep going!
  • HI FOLKS,
I think i have boobed big style! I am at stage 4, reclaiming charges (offered to accept 25% off the total charges less the interst), however my letters from day one have been asking for the lst 6 years! I live in Scotland and now realise we can only claim lst 5 years! They have not mentioned this to me, and did send me the last 6 years statements as i requested. Does anyone know if this will cause me problems, especially leagally if i have to go to court? Would love some advice. Just sent letter off.

Hi Lorraine, I think this is a good question and would be grateful if EDINBURGHGLASS would answer it for both of us. I am at the same stage but might have claimed one month over six years in England limit, but bank are defending, so would appreciate any insights as to how this affects claim resolution.
