    Stick to you're own time scale not theirs,yes you should start court proceedings now.

    Just an update re Clydesdale Bank - we went to court on 3rd April and they had a solicitor representing them. They asked for a continuance of 3 months which they got (which was utterly ridiculous as it would normally be a maximum of 1 month) and we have now received formal defences which have been lodged in court. Inevitably they have denied all charges and we are back in court on 23rd June. Watch this space!!

    Only at first stage so patiently waiting for the reply. I am in a bit of a muddle what to do next however as I now live in England so what court system should I work under? Its all getting to much,but I will go the whole way as I remember the times I was sitting with no money because Clydesdale bank had charged me near £100 for going 1p over. This was normally due to some charge they originally took. Dont mind paying to use things but always thought banks were out of order.
  • I am about to start try to get my charges back form the Clydesdale bank in Scotland. I was wondering anyone has done it against them before. I would be grateful if you could advise on how you got on and what they are like.

    Any help would be very grateful.

    Are you still waiting for your statements, and if so, how long ago did you send for them?

    There doesn't appear to be any success stories from the clydesdale bank. Anyone out there had any success with them?

    I am starting court proceedings next week. I have received 2 cheques, 1 I sent bank and 1 I kept. Will advise how I get on. Don't like the post from spcm about the three month continuance though.

    not been on this section for a while now but I succesfully got money from Clydesdale Bank. Granted they took the P*** at times but got there in the end.
    Rough story was sent all letters, got court date, expected them to pay up just before but they sent me a letter offering full payment if I replied by 15th of the month (the letter arrived 18th of the month, 3 days before court date). Decided to ignore rather than attempting to send back and take my chance in court.
    Was also claiming LLoyds tsb at the time and they also didn't pay by court date. Squeeky Bum Time!!!!
    Went to bank at a minute past midnight on day of court case and no funds from either in my accounts, Major Squeeky Bum Time!!!!
    Showed up in court, went before judge for him to ask why I was claiming LLoyds as he has statement showing they had paid (!!!!!!s transferred money at 9am, court case at 10 onwards).
    Yes I'm thinking Clydesdale will be the same but there solicitor stood up asked for more time to prepare case and judge gave him an extension of 2 months, never got to speak about that.
    A week later got a letter offering full settlement as a goodwill gesture, so signed documents, sent special delivery and waited....and waited.... and waited... after 2 weeks spent a full week phoning them with no one willing to talk to me or call back. Eventually after threatening to take them to court got a call back some 3 1/2 weeks after offer to tell me they were dealing with it, another few days later a CHEQUE arrived which then took 5days to clear in THEIR bank from THEM??????
    BUT HEY THE !!!!!!S AT LEAST PAID, SO BE PATIENT AND PERSISTENT.

    I am at the stage where I am realising that court cation is the only way forward. I sent my 1st letter off on the 20th of Feb. I got the usual reply.....I've been phoning Leeds constantly...or I was, I called yesterday and realised that they are all talking crap. it's all stall tactics and lies. I put the phone down and called the "Customer relations manager".....phone lines were engaged, I called reception, couldnt put me through....so.....I called every number close to the one I had and got through to a few people.....eventuall I struck gold, I got the "Customer excellence" person.......so, I cleared my throat and let rip.......in no time at all I was chatting away with a customer relations manager. I told him that I wanted to make an official complaint against the leeds office and gave him the details. I received a call back and was advised that they were running behind...blah!...blah!....2 weeks....blah!.......so I told them that the answer was not satisfactory and I would take it to the Information Commisioners office......filled in the paper work this morning...............

    I am owed an absolute fortune, I will not be put off by any underhand tactics the bank use. I am owed money and I will get the money. I closed my account with them as they made incorrect charges on my account. It took me 9 months to get an apology and the "black mark on my credit" removed.

    I have also been looking in to court action in England although I am in Scotland.....its a bit of a grey area and I think it can be done.......Id appreciate anyone elses comments on it though.....it appears its a judges decision more than anything.

    Also, has anyone in the newsgroup went public with their quest?......
