Mass estate ticketing - should we all appeal?

The DVLA have responded saying that PTL "don't currently get DVLA data", so there is nothing further they can do.
OK then so NONE of you should appeal, you can all ignore the fake PCNs as they cannot link the cars to the flats.
If any of you get a follow-up letter after the tickets then ask the DVLA whether (and if so, when) the company obtained the address from the DVLA. It's free to ask so don't let the DVLA send you stock reply, make sure you make it clear you are asking about your own data and when a named firm accessed it.
If the DVLA say the data was supplied then it's a complaint to Mike Butler at the DVLA!
If they say it wasn't supplied by them then it's further pressure on your managing agents for supplying your personal information to a disreputable company who have previously been kicked out of the BPA, and as such, it's a further example of the negligent way the whole parking operation has been handled. State that none of you will be paying and the parking firm will be facing multiple harassment claims if they attempt to send out further debt collection rubbish; if the parking firm want to try Small Claims it will be defended with copies of all the paperwork showing this farce. And P.S. you hereby opt out of the whole ridiculous money-making scheme and do not recognise any authority from PTL whatsoever.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The language for opting out should include that you withdraw all implied access for the Mgt Co, their agents, employees, and subcontractors, to your land, including the parking space.Je Suis Cecil.0 -
Doesn't it break the dpa if the housing association is handing out confidential information to a third party company ? As this company probably doesn't even comply with ico I would suggest a complaint in that direction as well .Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

I don't think anyone has paid the ticket, I haven't had much interaction with neighbours.
As it seems that Parking Ticketing Limited may have a dodgy past, and has certainly established themselves as unfit to ever return to our estates, I'm setting three increasingly ambitious goals:
1) Convince my housing asssociation to ditch the services of PTL
2) Put pressure on the BPA to expel PTL
3) Get the PTL shut down!
I'm fairly clear how to go about goal 1, but not goals 2 and 3. Are they unrealistic? Would they require media pressure?0 -
Media pressure is good, MP's involvement is good, BPA as well even though they are spineless but they can impose sanction points - and certainly DVLA pressure as they have banned half a dozen firms from data access for 3 months after complaints from keyboard warriors like us!
And Office of Fair Trading pressure if they break the law and debt collector guidelines (CPUTR and the specific OFT 'debt collection guidelines' may be worth a look).
I suspect that PTL are so new they could easily fail to meet the standards needed for DVLA access after 6 months of a probation period as a PPC - if you keep reporting them and get the situation known you could have an effect. I'd set option one as your goal. speak to the residents and see if you can arrange a meeting. Be good to know the neighbours anyway in case you need to deal with future issues.
If you have a majority then it makes it easier for the HA to be forced to listen and to act in the name of the residents (similar to a residents association).
Media pressure can be good here. Be a great photo of all the cars with their tickets on. I'm sure the local press would be interested in it as a story.
You could then use the reasons given by your HA for sacking PTL as ammunition to move on point two.What if there was no such thing as a rhetorical question?0 -
I suppose in this scenario they don't need the DVLA coz the HA give them details from the permits ...although wether they are allowed to do that is questionable ...
According to the DfT
"The landholder can only request registered keeper details from the DVLA, and not obtain this information by any other means in order for Schedule 4 to apply."

So as DVLA say PTL have no access to their data then everyone who has a ticket can ignore it totally if they are the keeper not the driver , or if they are the driver they can ...yep ..ignore it and PTL can then do nothing as they have no way of identifying the driver :rotfl::rotfl::rotfl:0 -
