Mass estate ticketing - should we all appeal?
Comments
-
check your lease/rental agree, ment, if it says nothing about permits there couold be a few options open to you along the lines of right to peaceful enjoyment of your property.
In the meantime why not make sure that everyone on the estate knows just how useless these tickets are, and then starta little competition to foster comunity spirit, something like see how many tickets you can collect in a day/week/month?From the Plain Language Commission:

Thanks for all the replies and advice. I like the idea of them running up multiple appeals bills. But this still means all the tenants have to do something. Many of us already phoned the HA in the first place, so however much contempt we may feel for the parking company, I feel really aggrieved that the HA expects each tenant to appeal, rather than sorting it out themselves.
I'd like to be able to tell my fellow residents to bin the tickets and give the HA the finger (so to speak), but I want to be sure they won't get into trouble if the parking company chases them for payment.0 -

A few pepipoo flyers may be of use http://forums.pepipoo.com/index.php?showtopic=73598 you could even give one to the ticket bod/place one on his/her car or give them one, as in my expeirience parking company employees are as clueless as the rest of the general population about the validity of the tickets they give out. From the Plain Language Commission:

The parking company may well chase them for payment, but there almost certainly won't be any "trouble". Plus, as others have said, check your lease/rental agreement as it is very likely the HA have no right to have brought in a PPC.0

Look at it this way, if the HA does a mass appeal then it could be 1x£27I feel really aggrieved that the HA expects each tenant to appeal, rather than sorting it out themselves.
If you all do it its a lot more impressive.
Was it since the 1st Oct?I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0 -
I'd circulate a letter, something along the lines below, to every resident and get them to send it to the HAThank you for your letter apologising for the inconvenience caused to residents by your agent PTL in ticketing resident's vehicles for 'displaying an invalid permit' when all these vehicles were displaying a valid permit supplied by yourselves.
You are responsible for your agent's behaviour. Should PTL pursue non-payment of these charges through the county court, as they have threatened, then please take note that the Housing Association will be named as co-defendant in any counter-claim.
However, rather than let matters reach that stage and since this situation is of your own making, it would be far better if you sorted it out between PTL and yourselves without putting residents to further inconvenience and distress0 -
There is absolutely loads of scope on that website for a complaint to the DVLA for the use of the word 'fines' for a start! Spot the word here:
http://www.parkingticketing.co.uk/index.php?option=com_content&view=article&id=172&Itemid=270
And they make outlandish claims like saying in similar words 'using a non-BPA member as a contractor is illegal'!
And just look what they threaten on the back of their example permits - clamping!
http://www.parkingticketing.co.uk/index.php?option=com_content&view=article&id=88&Itemid=176
And:
''Parking Ticketing Ltd are the industry’s leading company in the UK '' and yet we have NEVER HEARD OF THEM until now, they are new kids surely, clampers jumping on the ticketing bandwagon (badly)?!
And what about this bit:
http://www.ptlappeals.co.uk/index.php?option=com_content&view=article&id=102
''Parking tickets and charges, especially those issued on private land are hot topics for debate often fuelled by armchair lawyers who use various media such as the internet as their soapbox - As with many aspects of the internet this advice is very often ill founded and the people giving it are not legally qualified in any way and very often hide behind aliases and appear on many forums under multiple identities.''
:rotfl::rotfl:
And this is all very interesting:
''PTL are one of the few companies that rigoursly pursue unpaid parking charges via the courts and all cases are dealt with by our team of in-house legal experts without using third parties.''
And yet:
''Photographic Evidence:
Offenders should note before making an appeal that all vehicles are photographed by digital camera, which is date- and time-stamped showing the offence committed.
Photographs are for internal use only and they will only be passed over to a specialist debt collection agency and used as prosecuting evidence.''
I reckon this company needs stuffing firmly back down the hole it has been digging so I would appeal to them to see what rubbish you get back! Then appeal to POPLA, and also complain to the DVLA about the use of the misleading words 'fines' and 'illegal' and 'offenders' and 'prosecute' (all wrong, all misleading, all a breach of the BPA code of practice)..
Does the 'ticket' say anywhere that the registered keeper is liable? What about the signs, do they say the registered keeper is liable?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Good point - all appeal individually but with knowledge that you will not be paying it. I reckon the OP should put a copy of this thread up in a few conspicuous communal places or post it in people's letter boxes. People need to know NEVER to pay a fake PCN and not to worry about the scam of fake parking tickets. Even if people don't know the ins and outs of the scam, you only have to play 'spot the spelling mistakes' on that website to see what a professional outfit these newbies are.PRIVATE 'PCN'? They've got perky sussed ! :rotfl::rotfl:
You couldn't make it up could you ! I am creased with laughter.
All you doubters of PPC tickets, just remember this, YOU could start a Private Parking Company up tomorrow, can you "fine" me? No, absolutely not. Why believe the extortion letters coming through your letter box then?
My daughter got one 2 year ago aged 18, what did she do? Totally ignored it. She still drives and hasn't had those pests, the bailiffs what were promised, calling yet, they must be busy !
The word is getting out, love it.0 -

The date/time stamp is reliant on the cameras internal clock being set correctly, i could easily take a photo of a vehicle, take the little internal battery out of my camera ( that keeps the time/date settings constant ) and or change the date time, and aphoto that was taken 1 minute from the last one could now easily be a few hours/days or what ever i have set.
