Gone to Court?
Still waiting to hear if anyone has had to actually go to Court with Abbey and what happened ... ???
Abbey are defending my claim but have not provided the required papers to the Court or to me by the stipulated date. The Court says I have to chase Abbey for them. If they don't provide them or don't turn up on the day, the Court could adjourn rather than making judgement in my favour! Seems a bit unfair.0 -

I don't quite understand this. You should not have to chase Abbey up for them to defend their claim (it's their problem). If they don't enter their defence in the allocated time. Go for judgement by default. If they enter a defence after this, the judge may very well let then continue the case.How many surrealists does it take to change a lightbulb?

Abbey already sent defence to moneyclaim online so it is in the system but it's the papers they need to rely on in Court that they have not provided. According to the Court, the could theoretically turn up on the day with their own evidence and I'd have to ask for adjournment to consider it. Then the ball would be back in my court (ouch!). I'm just hoping they will drop their defence and am looking for other people's experience of this stage in the proceedings.0

I had the standard letter from Abbey to say they would look into my complaint, 1 week later I recieved this,
I have have carried out a full investigation your behalf.
I'm are sorry you are unhappy with the charges and understand you would like these refunded.Although the charges are correct, as a gesture of goodwill, I am happy to refund £250. Your account will be updated to show this.
I appreciate you feelings on this matter but we are satisfied that the charges do not contravene consumer regulations. We also comply with the Office of fair trading, in dealing fairlly and openly with our customers.
They go on to say when I opened my account I was sent regular updates and tarriff of charges BLAH BLAH BLAH
Also telling me how to avoid charges in the future, and that when there are insufficient funds in an account, they are dealt with manually. This costly and our charges reflect the administration costs involved handling these.
Please be assured I have carried out a full investigation for you and I hope you feel I have offered a considered and complete response to all the issues you have raised. I will keep your file open for the next 8 weeks and if I don't hear from you with in that time, I will assume that every thing is resolved and will close your file. If you remain dissatisfied though, the leaflet you find enclosed will explain your rights and how to take your complaint further.
On the same day I recieved this letter I had already sent out the letter to take them to court. AND £250 had been deposited in to my account
I am not satisfied with this amount, and they put it into my account without asking me if I agreed first. I have got the court papers ready to go.

OK, it sounds like they're hinting at using manual intervention as a defence.
Did you send the Data Protection letter with a request for manual intervention information?0 -
We have been through the procedures and have received from the court an acknowledgment of service.
Abby National have said that they are intending to defend the whole of the claim, what does this mean? and is it normal procedure? or am i to be the first scapegoat in britain?0 -
dmguire275 - I'm ahead of you - see my earlier posts. Have Court date 14 Feb but Abbey have not bothered to provide evidence, so I'm hoping they will cave. Have not heard from anyone else who's gone thru' to this stage. Meanwhile you will have to carry on.0

I told them it will still be persued on the phone as they know full well they cannot win the case and won't even defend it. However, if i'm honest guys, i don't think their charges are terrible (although don't quote me to the judge) i'm only in it for the money, not the Justice against the system
However, it's still £250 they paid into my account today so i'm a happy boy
