  • think i know the answer to this one, but just want to double check...

I am due to issue a judgement via money claim tomorrow, i have received a letter from the abbey today saying they need 1 month to look in to my claim, they still haven't issued a defence dispite writing to me last week to say they would be. so do i just go ahead and press the issue judgement button tomorrow?

If you didn't receive this letter (or received it Monday ;) ), what would you do? If you do apply for judgement, they may enter their defence late anyway. If this happens, the judge will very likely allow them to continue.

  • Thanks Rex,

I just can't wait to hit that judgement button :) Here's hoping it goes my way :)
  • Right I have had an offer of goodwill for 170 quid, i have refused this and wrote to the bank saying that i was only accepting this a partial repayment for 800+ inc interest which is my claim against the SHABBY.

They wrote back last week saying that it was their final offer, what do I need to do to reclaim the rest of MY MONEY?

    Any Info would be great!

Follow the steps in Martins article. If you have only sent the first letter asking for the charges back, send the second one. If you have sent the second one already, start your court claim.

I've got out opf sync with my Abbey Claim. I originally sent my LBA at a time which meant that their 7 days were up on 25/12. In January I checked they had received my letter (Christmas post and all that) and they said they had and had 8 weeks to deal with it. I soon received a letter saying they were investingating my complaint and would respond with in 4 weeks. So I thought I'd hold fire and see what they came up with. However, for once they got their skates on and managed to send out another letter after only two weeks. Sadly, they told me that their charges were completely lawful and they weren't going to refund any. Should I send the LBA letter again (they've probably forgotten about my first threat now!) or take them straight to court?
    I have plenty of willpower - it's won't power I need.

I had the same thing happen with my claim against Lloyds.

I left a big gap after sending my LBA, I just continued to the next stage and filed a claim online.

My case has progressed as normal since then.
  • hi guys i'm new here and was just wondering if anybody could help me. i have been charged today £50 by my bank (abbey) for making payment while overdrawn and being overdrawn for 1 day for £4.11, and this has happened a few times thanks to internet banking or my bank, but i was just wondering if i can claim it back before i go through the process descirbed on the site

    many thanks
  • You can certainly try a phone call and quote from Martin's article and see if that works.

If it doesn't then gather the info you need and send the first letter which may just do it if it isn't a large amount.
