Hi,
I asked Abbey National for my statements in December they cashed the cheque in December and most of my statements were sent through in December. I sat down after the holidays and I have realised that they have not sent me statements from 1st Jan 200 to 31st May 2000, so I phoned them last week as per your details and then received a letter this morning saying that:
"Abbey is not normally required to hold past transaction details on accounts for more than six years, we're therefore unable to give you the details you've asked for the period 1st Jan to 31st May 2000"
So I called them again to say OK I now realised we are in Jan so from Feb to May and they have said that everything for 2000 has now been destroyed and can't supply me with the information. Where do I go from here? I am happy to report them to the ICO but I obviously do not know what I have been charged in these months and therefore can not complete my claim.
I do believe the above is a lie but I can't prove that!
Any advice would be helpful

If you sent off for them in December 2006, they would only need to produce December 2000 onwards, did you receive this statement.

so your saying from Dec 2000 I can claim from so they are complete.
My stupid confussion with dates they have confussed me by sending June 2000 onwards!

Just a quick note to say that the abbey took 3 weeks to refund £595 0f the £820 i claimed - many thanks for the information given !!!0

Hi,
I am going to be reclaiming all my charges from Lloyds Bank in the not too distant future. I have however left them because I entered into an IVA situation, and I am now with Abbey.
I have this week found myself with £110 worth of charges for going into my overdraft. I have been trying to transfer money across from Paypal and Cahoot last week, but because of the ridiculous bank clearing system the money failed to reach the account in time, (its still not there, but should be by now) - they have charged me £110 for various DD that have gone out plus an overdraft fee.
Having spoke to them on the phone, they decided as a goodwill gesture that they would refund all but £30.00. If the charges are legal why are they offering me this, and why can't they take off all the charges?0 -
I sent the DPA letter on Dec27th to Abbey. Received 12 months of statements yesterday in seperate envelopes each one had the charges panel removed from the front page. I phoned to ask about the other 5 years of statements and have been told they would be at least 8 weeks because they are kept on microfiche. When I pointed out that they have to provide them within 40 days(on checking with the ICO I find this is 40 calendar days not working days) I was told that the DPA dd not apply to statements which had obviously been sent to me in the past.0

Write back to them, and tell them if you don't receive the statemnets within 40 days, you will complain to the Information Commisioner. What they are telling you is not true.How many surrealists does it take to change a lightbulb?

Has anyone actually had to take the Abbey right through the Court process? I did all the usual letter stages and then resorted to MoneyClaim Online. Abbey is defending the claim (Court date set for 14 Feb) and I'm getting a bit concerned that I've messed it up somehow and that they will follow through with it!0

I am virtually at the Court Date situation (21st Feb) To date I have followed the step by step guide and been workin through the CAG forum.
However I am confused about one aspect and concerned my misunderstnd may jeopardise my case. Unable to get this clarified elsewhere due to the volumes of traffic and questions on CAG which is exceellent by the way can anyone clarify my position here.
I have completed and returned my AQ's subsequent to which I received my court date (21st Feb) and a request to submit my schedule of charges, supporting statements and a statement of evidence. This was done and accepted by the due date (15th Jan). Abbey have until 12th Feb to do the same plus a few extra clauses. I only got clauses A) & b)
My question is at what point am I requested to submit the court bundle.I am in the process of preparing this but I have not been asked for it and am unsure when this will be requested or if I just take it with me to the court.
Has anyone had a similar experience and how did you deal with this?
Or is the Leicester CC Small Claims Track not requesting bundles ....

Phone the court and ask them how your case is progressing, and explain your concerns to them. Give them your case number, and they can access your information quickly. I've always found court staff very helpful.
