    I AM NEW HERE ONLY JUST PLUCKED UP THE COURAGE TO JOIN AND POST.

    i just have some questions that im sure have been answered previously but i cant find them so sorry in advance if you are all repeating yourselves.

    here is my story :
    i have a single a/c with abbey and a joint a/c with my partner also with abbey. and my partner has a single a/c with abbey too.

    so 3 a/c in total. we had overdrafts on all 3 a/c and were up to the overdraft every mth. also because of the charges imposed by d/d failing and cheques bouncing etc we got ourselves into a pickle. we stopped using the a/c(s) and asked a debt management company to arrange a payment plan to help us pay back balance owing(due to overdraft and charges) we are 1 yr into this plan.
    we are about to ask for our charges back

    so basically questions are :

    1) do i need to send off £10 per a/c

    2)can i still ask for charges when im on a payment plan with a debt management company.

    3) has anyone been took to court and had to go to court to get charges back?

    4) what are my chances of getting charges back estimating about £3000 on each account we held with them.

  • Well, I requested my 6 years worth of statements at the beginning of November!! They arrived yesterday. The last 14 months came in 14 seperate envelopes and all the one before that came in one MASSIVE envelope. I spent last night with a pink highlighter pen highlighting all my charges. I haven't added them up yet and will spend tonight doing that. Now I am doing it I suddenly feel all scared!!! :confused::confused:

    Ideally, you need to make a list of your charges now. Don't send your statements back to the bank.

    HERE is an example of how I list the charges out using Word (add the years up at the end).

    You can only do this if they refuse to pay and want to go to court. It's very unlikely this will happen, so I guess the answer is you can't really.



    Other people have claimed for business charges, but the procedure is slightly different.



    You shouldn't have to go to court, they should pay up before the court date. Also Abbey often seem to close accounts, so be ready for this.
    Hi there, cheers for replying. Yes, I originally requested the amount WITHOUT interest added. Can I still do this? It is in court on 27/03/07. How do i request the financial disclosure of administration costs from abbey? I was 16 when i opened account, is this classed as being a minor? Is it too late for me to again write to the bank settling for the amount requested WITHOUT the interest and expected damages on the basis that this doesnt go to court? your help is appreciated
  • What do I do next????
    I sent letter to Abbey requesting refund of my bank charges, within 14 days they replied saying they are sorry that I am unhappy and felt I must complain. They say they want to resolve this quickly but they want to carry out a thorough investigation,if they do not contact me before they will write to me in 4 weeks to let me know what is happening.
    Now should I wait that long or take the next step?

  • I'm at stage three and have sent the template letter demanding just over £1200.00 in bank charges the 14 day deadline will be up on friday 19th jan
    on teusday 16th jan I recieved a letter from the abbey, I'll give breif descrpiton starts of kind of standard.

    thank you for contacting us and i am sorry that you have been so unhappy that you felt you must complain.
    one of my team will be responsible for investigating your complaint and have enclosed our complaints leaflet (steps 1 2 and 3 stringing it out, no doubt)

    I no it is importantant to you that we resolve your complaint quickly. but we want to complete a thorough investigation and somtimes this can take time. if we have not contacted you before, then we will write to you in four weeks to let you no what is happening.

    (this is the part of the letter I find slightly confusing)

    if you have employed someone to handle your complaint on yor behalf, please note employing a third party complaint-handling firm, or a solicitor, or finacial adviser does not affect how we review your complaint. please be aware.
    1 abbey does not charge you to investigate your complaint.
    2 abbey will not be liable for any costs that incurred if you do decide to employ a third party to handle your complaint during this reveiw.
    3 abbey, in general, will only make payment directly to the acount holder if your complaint is upheld and redress is due.

    although I do not no what the outcome will be, I do hope that we will be able to find a solution that you are happy with.

    heres the sticler, I was very helpfull.. collated all the statements nicely, highlighted each charge (eluminus green) you no the ones, sent the lot back along with calculation sheet and also my letter of demand.

    does it really take up to four weeks to get back to me, are they bluffing..?
    do I sit it out..? or do I stay millitant and go either or ither of stage four.

    is their anyone whose had the same kind of letter from the abbey would like to no your advice or anyone else at that who can advise.

    instict says go for it, but i feel a little lost at this momment in time.

  • This is Abbey's standard letter so stick to your timescale.

    i have sent them a copy of the interest calculator - do i just send them another copy of this? and do i send this to them now or await to hear from the court and send it straight to the court?

    Send a copy of your schedule of charges inc interest to both Abbey and the courts(just ask them to add to your claim file). Make sure you include your claim number on both of the letters and send via 1st class recorded delivery.
