    Don't let the bank dictate a timescale to you.

    Stick to your timetable and send the second letter, I would send it now rather than wait till the 14 days is up as they have already responded to your first letter.

  • HI I wonder if anybody can give some advice. I duly wrote and claimed back £549 from the Abbey for bank charges over past 6 years. They credited my account with 260.00 last week, and the following day a letter turned up to say that the charges they had applied were correct, and as a gesture of goodwill they were happy to refund £260.00. They continue in the letter, referrring to Tariff and charges and say that the charges do not contravene the Unfair Terms in Consumer Contracts Regulations 1999,and that they have carried out a full investigation and hope that I feel that I have been offered a considered and complete response to my issues. They will keep my file open for the next 8 weeks and if they do not hear back from me, will asume everything is resolved and will close the file on the matter.

    Just a bit of advice, do I stay grateful for the refund I have received, or do I reply and request the return of the remaining 290.00. Any advice would be appreciated. I am shocked at receiving the 260.00 and dont want to push my luck.

  • As you can read this seems to be a standard reply from Abbey. You can right back and say you would accept their offer as partial payment but will progress to court action ... but the decision is yours.

    I have also jumped on the wagon for reclaiming charges back.
    I have been charged hundreds over the last few years with Abbey and am now looking to reclaim them back. I still owe them £400 overdraft before the account closes and am struggling paying it. Although, i have another account now which i am managing better.
    I am just about to send my first leter (using the very useful template, thanks!)
    But this is all a bit scary, has anyone out there reclaimed from Abbey?
    Can anyone tell me what to expect from them?
    Can anyone give me any tips? because i'm kind of hoping that it wont get to court stages but am prepared to fight this until i get what i'm entitled to! My charges to reclaim run into thousands and i could really do with them back!!:confused:

    Ok- I have added up my charges and they come to a grand total of £2153+449.09 interest= Total £2602.09.
    Feeling scared now and about to post my first letter asking forhte charges back.
    Please can it be confirmed that I have to send this letter to the local branch? I would rather not becasue they know me in there. Does it have to be sent locally ?

    All they will do at your local branch is forward your letter onto the relevent department. They will not be dealing with your request in the branch.

  • Hi everyone, just thought I'd chime in. I sent my first letter off on Friday 19th January to both Abbey and Smile. I closed my Smile account about 3 or 4 years ago, so I don't hold out much hope for that one, though their charges caused me much grief when I was at Uni.
    I have a joint account with Abbey but it's my personal one I'm claiming charges back for. I noticed they do close the joint one too if it goes that far so the wife has opened a Natwest account (I've opened an Alliance and Leicester one) for a backup. I'll be keeping a beady eye on this thread to keep up to date with Abbey's shenanegans.;)
