Send a copy of your schedule of charges inc interest to both Abbey and the courts(just ask them to add to your claim file). Make sure you include your claim number on both of the letters and send via 1st class recorded delivery.

Thanks so much, i really appreciate your help...I'll do it straight away.
  • last week i got charged £30 for being £2 overdrawn for one day. I rang Abbey who told me that as they refunded me when I was in a similar situation last sept, they wouldn't refund monies twice in a year. It's only a small matter compared to some, but is it worth me pursuing the case?
  • We requested our back statements on 4th Dec 06. On day 39(last week) we received a letter saying our back statements were following under seperate cover. After waiting a further 5 days we rang Abbey as othing had arrived. They told us that because of the way the info is stored it could take 6 weeks from the date on their letter (5th jan) to get the statements. Are they just delaying tactics and if so what can we do now? When we rang they said this does not break the data protection act.

They are not being truthful with you. They are breaching your rights under the Data Protection Act. Use THIS LETTER as a template (change it a little to fit your circumstance). Mention in the letter, you find a further six weeks delay unacceptable, and unlawful. Send this off ASAP.

  • Thanks for your advice, this whole process is a mine field.Would like to see some more success stories of people getting their money back from Abbey but compared to the other banks the Shabby National seem quite difficult to deal with

Move onto the next stage once your deadline is up.

  • I've successfully claimed £70 bank charges from Barclays (the bank I currently use) but I've also made a claim against Abbey for charges of £360 on an account I closed a year ago (due to excessive charges!). They are going to defend the claim and I need advice of how to back up my case - can anyone offer any help??
  • I have requested the statements for last 6 years from Abbey yesterday via their internet banking service. I rang today to chase and check that my request would be processed. They informed me they couldn't check exactly but it should be fine and would take.....8-9 weeks to collate the information.

Is this the average wait time for the data?

    Hi all,

I sent my first letter to Abbey requesting repayment and a responce within 14 days.

7 days later and I've had a letter back (!!) saying, amoungst other things, that they will complete a thorough investigation and will write to me in 4 WEEKS to let me know what is happening.

What do I do? Do I send the next legal action letter now or should I wait for their responce in 4 weeks?

    Any help gratfully appreciated.

    Thank you
