Hi - I have received my statements from Barclays and am in the process of listing the charges and dates in order to place my claim. Initial trawling indicates I am looking at a sum in the region of £3,500.
I have had an offer of £1,000 in "full and final settlement". Can I accept this "on account" and "without prejudice" in writing and continue to claim the balance? If so, is there a template letter somewhere? It would certainly help to reduce my overdraft in the interim as I am still being hammered for charges - it's like painting the Forth Bridge!0 -

If they will only allow you to accept this as full and final settlement, you need to reject it and state you will only accept the full amount. You could remind them if you have to go as far as filing a court claim, you will be adding interest and court costs, so it's in their favour to settle now.0 -
Hi, I have gone through the whole process and last week got a letter from a solicitor saying that although they did not accept the charges were unlawful they would pay the money in full and final settlement so I just had to sign the letter to accept and send it back. Which I did, thinking I'd won....
Then this week I got a letter from the court saying a defence had been filed and I have to fill out the questionnaire and take it with £100 to the local court.....
Has this happened to anyone else? Does anyone have any advise on what to do now?0 -
Just about to start filling in the Moneyclaim form this morning - just a quick question.
I have had another 2 charges since my original letter to Capital One for my claim. Can I now add these on?0 -
I have already asked this question a couple of weeks ago but nobody has taken it up so here goes again; if somebody who doesn't have a fixed address tries to claim charges, what happens? How do you keep up correspondence especially when you need to threaten the court action and have no local court because you are on the move?
I would be very grateful for any help on this one0 -

Thanks Nick Mack, that would be in Manchester I think. It's closed now but I know that's still ok to claim for.0

If this is still a valid address for the claimant, then use this. If they are not able to receive mail, it may be a little difficult to claim as letters need to be responded to. Particularly if it gets to the court stage where information must be sent on time.0
