This happened to me too with HSBC - they sent copy of some statements but are a year short. Haven't received any for 2006 when the main costs occured. Have written to them pointing this out as well as reiterating that I have already paid for these. Still waiting for their response. Interestingly HSBC sent out their copy statements as single ones all in separate envelopes so easy to see where the £10 goes!0 -
Edinburghlass wrote:But what letter have you sent them then? To get them for the maximum of £10 you need to use the first letter template in Martin's article.
I wrote the letter before I discovered the website so it was just asking for the bank statements.
I will use the template this time though, and will send it by recorded delivery as I have also had the "we never received any letter" excuse, so hopefully this will get their attention!0 -
Hi
New to the forum though not to this brilliant website found by listening to Martin on Radio 2's Jeremy Vine show.
We have just started to ask for our charges back from First Direct. We received 6 years of statements today so I have been through them and listed everything the bank has taken off us. Can anyone tell me other than Overdraft fee and excess overdraft fee (which i believe we can claim as I read this on another thread) what else we can claim (don't want to claim what we shouldn't!!).
We have an "unpaid cheque" and quite a few "charge renewal fees" as well as debit interest (this alone amounts to over £600) I noticed that they took debit interest from us during a period of 8 months when we were in credit all that time. Surely that can't be right?
Anyway would be grateful for some help so I can send my 2nd letter.
Many many thanks in advance.

Post 4 in this thread gives you the list of what you can and can't claim.

You can't claim the interest for going over overdrawn. Your statement may show you are in credit over the month but if money has been paid in on a certain date it might not be a "cleared" amount.0 -
Hi, I am currently trying to reclaim money from Abbey. The situation so far is this. I had got as far as sending the second template letter, giving the bank the option of paying a lesser ammount in the "without prejudice" section . The ammount was £2500.00. I had heard nothing by the deadline I had given them, and so lodged my claim with moneyclaim online. The day after that I noticed that Abbey had refunded several charges to my account totalling £250.00. I have had no correspondance from them telling me what this is for, or if they agreed to make any payments to me.
My worries/ questions are these:- i. Are they going to try and claim that I said I would accept £250.00 instead of the £2500.00 I asked for? I have coppies of my letter to them stating that £2500.00 would be acceptible.
ii. As I have heard nothing from them, do I allow the moneyclaim to run it's course in the normal way?Do I need to notify the court?
iii. Should I approach the bank in writing to question their action, or wait for them to contact me?
iv. Should I issue a reciept and state that the ballance owed is now the full ammount with interest, minus the £250, as the period in which I would accept the reduced rate is now over?
I would be interested to know if this is a common tactic by the bank, and would appreciate any suggestions you could give.
Many thanks in advance0 -

i. You have copies of your letters. Use these in court (if it gets that far)
ii. Too late for the bank now. You offered to settle for a lower amount, and they didn't do this. Now, you should only settle for the full amount of the charges+interest+court fee. Keep going with the court claim.
iii (and iv). Write to the bank and say something like...........
I cannot accept your offer of £250 as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you refused my offer to settle this. I will now settle only for the full amount of charges+statutory interest+court fee.How many surrealists does it take to change a lightbulb?

hi all
i sent my request off to barclays on the 27/12/07 for all my charges on mine and my partners accounts i added the 10.00 fee to each account.
i receieved a letter back from barclays both on the same day and dated the 12/01/07 with my returned cheques and hand signed
it says (short version)
please be aware that the bank is not under an obligation to present information according to any particular format.however, you may of course obtain this data from copy statements and these will be supplied to you within the next few weeks without charge on this occassion.we would advise however, that statement information prior to 2000 is stored manually rather than on computor.therefore, if your account was opened was opened prior to this time, there may be an increase in the time required to collate the information you have requested.i apologise in advance should this delay be the cause of any inconvience to you.
as the bank is providing the copy statements on a complimentary basis your payment is returned herewith.
are they just delaying me?
thanks

They have 40 days to provide in the information either in list form or statements, if the 40 days is up phone them and tell you will be complaining to the ICO.0

There is no way I can find my original post, or the reply, but I know it said we shouldn't have estimated the charges.
This is what I was going to say when I finally found it.
Thanks for the advice.
He sent the letter to the Shropshire group of branches in Shrewsbury yesterday.
I take it he should immediately apply for information the bank has regarding his accounts. Will he get this all for a tenner, please, and should he have written to the London address?
I guess this question has been asked before, and I made a valiant attempt to read the whole thread yesterday, but fell to sleep first.0
