  • On the template letter to the bank (2nd letter) where it says (name of court) what is supposed to be written here? Is it Small claims court and name of town or county court and name of town? or neither.

Have asked this question already, but desperate for an answer: we have a joint account and don't know if we can put both our names in claimant box on MCOL.
    Quick answer needed please!

Make the claim in either of your names.

yea to right get the letter sent :-)
Do I need to wait til the agreement has finished or should I do it now?
  • I need to request 6 years worth of bank statements for my partners now closed account with Nationwide.
I have already sent one letter asking for these and have had no reply.
I intend to send another in the next couple of days.
Does anyone know what I might be expected to pay for these?
I was told I'd have to pay £10 per statement but I'm sure I've seen somewhere that I'd only have to pay £10 for the whole lot.
  • If you ask for statement the banks are quite entitled to ask for a charge per statement. You should be asking for information the bank have regarding your accounts under the Data Protection Act. They have 40 days from the time they receive your letter to provide this information and they may send it as a list or it might well be statements.

Please read Martin's article and follow the step by step guide which suggests you enclose a cheque for £10 when you send your SAR.

  • I could do with getting the statements if I can as I had to claim some charges from them when they returned direct debits when there was enough money in the ccount and then charged £30 for them. So I need to take this from the total.
What can they legally/ lawfully charge for the statements?

But what letter have you sent them then? To get them for the maximum of £10 you need to use the first letter template in Martin's article.
