If they have over 10k in savings they recieve an automatic refunds. so basically the ppl who could in theory afford to pay a charge and refunded and the people at the bottem end of the income scale are advised "it is within the terms and conditions of your account to stay within ur limit and should monitor there acc" oh and then we are supposed to "tag" them for a personal loan as an attractive option for gettin rid of all there exsiting finance. its disgusting.
Absolutely!!!! It is good to hear this and it makes me soo angry!!! I have a lowish and erratic income therefore always have a hard time with my finances. My bank - HSBC Bank Robbers plc- will never up my limit and have always kept me tied up in loans etc. I have been offered loans all the time but never do they just stop charging me when they see I am in trouble and very often because of their charges. They make a mint out of me! As someone quoted on this forum - a bank is an institution that offers an umbrella in fine weather and takes it away when it is raining!
  • I am in the process of writing my third letter to my bank, where I am requesting a settlement less 25%. In Martins template letter it says "Insert Name of Court". How do i find out which court I use?

I sent my 1st letter on 17th January asking for over £2,000 back in charges and I received a letter back on 26th January saying they are considering my claim. The 2nd letter about taking them to court was sent 6 days ago giving them 7 days and have received another letter today saying they are considering my claim and will respond as soon as possible.

Are they just stalling do you think.

Yes, they are stalling you. Ignore any timetable they give. Move on at your own pace.

Natwest seem to like to pay out a lot of times only after a court claim has been issued. Don't worry too much.

After following Martin's directions I eventually filled in a money claim online form. Within 2 days I had a reply saying the bank intended to defend this claim and now has 28 days from the time I filed the action. Do I need to be worried by this ie am I the one in a million where they will actually defend or is it still merely posturing by the bank. After I filed with money claim I had a letter offering me £600 but am claiming almost £3000.

Lots of banks are entering a defence, but not letting it get to a hearing. They are hoping you will give up in the meantime. Keep going, there is an excellent chance (99.9%) you will get a full refund.

  • Posted recorded delivery letter to bank on 29th of January giving them 7 days to reply to the request of my bank charges to be paid in full with interest. No reply so called today, was transferred to head office and they are saying they have recieved nothing.I stated to them that by law they had 40 days to reply to my first letter which actually took 70 days.I was told that some other legal board has given them 8 weeks to reply.Just spoken to branch again they claim head office should have recieved my letter. They suggest I re-submit another letter, any advice please.

More untruths.........The banks do not have 8 weeks to comply with DPA requests.

If you sent your letter recorded delivery (so you can prove you sent it, and it was received). Move onto the next step as soon as your own deadline is up. Do not be delayed by the bank in any way.

The bank does not care about customers and have different rules. For example if a customer is adement they want a charge refunded but do not meet any of the obvious criteria we are advised to check any savings the cust has. Disturbing but not suprising.

    Hi Cookg79
I did the same thing and received a response back from the 'Copy Statement Unit' in Birmingham - but - guess what, they haven't listed the charges for 2003 and part of 2002. And does anyone know if I can claim back the interest they are charging because if they hadn't levied the charge the account wouldn't have been overdrawn

The interest you claim using Martin's Interest Calculator if it goes to court is the interest that covers this situation.
