  • Hi all,
    My partner and I are about to take on Lloyds TSB (account + credit card) Halifax (2x accounts + 3 credit cards) Cap 1 credit card, Alliance & Leicester Credit Card and Marbles credit card(HFC Bank) Will keep you posted with any successes.

    The help we need is in relation to the last one, HFC. This particular credit card had a £1000 limit. Anyway, to cut a long story short...got made redundant and ended up maxing out all cards while trying to make ends meet. My problem is this: HFC kept on piling on the charges until the amount owed reached around £1700. They then CCJ'd me with the total coming out with costs at £2079!!. Can I still try and get the charges applied to the account refunded? and does anyone know if you can defend a CCJ application in these circumstances....ie dispute the amount owed due to the addition of unlawful charges? I know its too late for me to defend the CCJ but for other people in a similar situation facing a CCJ I thought perhaps that the banks might back down if faced with revealing their true costs?! Any insight anyone has would be greatfully appreciated!!!

  • My wife is claiming against the Halifax and sent off the first letter with a list of charges plus interest on the 19th January.

    Today she was about to send off the second letter threatening court action when she noticed two errors in the original calculations caused , silly enough I know , by the use of the American notation for dates!

    What now - does she resubmit the first letter with the revised set of charges or continue to stage 2 with the revised set of charges?

    Advice would be appreciated.

  • brand new to this forum ..possibly asked before by others...have had a number of charges from bank for going over overdraft limit over the years also ive been bad for not paying credit card on time and received late payment charges ...ive always paid within a few days of either receiving reminder or telephone reminder...do i have any redress for these charges or am i wasting my time trying to reclaim them...? thanks....
  • i just logged on to this after seen the Wright Stuff the other day. I work in a call centre for 2 well known banks and i completely agree with what this site promotes. The bank does not care about customers and have different rules. For example if a customer is adement they want a charge refunded but do not meet any of the obvious criteria we are advised to check any savings the cust has. If they have over 10k in savings they recieve an automatic refunds. so basically the ppl who could in theory afford to pay a charge and refunded and the people at the bottem end of the income scale are advised "it is within the terms and conditions of your account to stay within ur limit and should monitor there acc" oh and then we are supposed to "tag" them for a personal loan as an attractive option for gettin rid of all there exsiting finance. its disgusting.

    You can reclaim all of these charges. Read Martins article to find out how.

  • I sent my 1st letter on 17th January asking for over £2,000 back in charges and I received a letter back on 26th January saying they are considering my claim. The 2nd letter about taking them to court was sent 6 days ago giving them 7 days and have received another letter today saying they are considering my claim and will respond as soon as possible.

    Are they just stalling do you think.

    Have read alot of success stories about Natwest where they have paid up and am now starting to wonder if I have to go all the way with the court action.

    Starting to feel a little worried.....
  • After following Martin's directions I eventually filled in a money claim online form. Within 2 days I had a reply saying the bank intended to defend this claim and now has 28 days from the time I filed the action. Do I need to be worried by this ie am I the one in a million where they will actually defend or is it still merely posturing by the bank. After I filed with money claim I had a letter offering me £600 but am claiming almost £3000.

    Any help would be very gratefully received.
