    See post #4 in THIS THREAD. Are there any charges you have claimed that are not listed there? It would also be handy if you listed out the charges you have claimed for. (not the whole list, just all the different type of charges you claimed)

  • i have looked at that post and it says that i can claim back returned cheque charges is this true i think that is what HSBC are disputing?!

    Yes, you can claim back these charges. Just push on with your claim.

  • It says on letter before we can properly consider your request you will appreciate that we must understand precisely to which overdraft charges you refer if you wish to pursue this matter please write to us again with a specific breakdown detailing the amounts and the dates of charges in question whereupon we will be able to connsider your request but i dont understand this because i followed instructions on this site and this is what i have done! so now i dont understand what to do now? thanx jo
  • So you think i should just send out the final letter saying i will take them to court then? I dont see why i have list all charges and dates again when i have already done this do i?!

    HERE is an example of how I list the charges out using Word. Just total up the years at the end. I would send the list in a format something like this.

  • My boyfriend is trying to reclaim his charges and despite my best efforts I've had to hold my hands up and say I've failed. He is awaiting about 2k. People haven't called back, they've insisted it's being dealt with and we've held off taking it to court (on the promise of an instant response) for weeks and weeks. Someone I helped had their claim settled weeks ago and they started at the same time. In the interim they have given him a credit card, levied more charges on his current account - all the corrspondence in the world but not about a settlement. He gets letters saying he hasn't attached a list of charges - even though we have done it twice!?

    It looks to me that a lot depends on the amount being claimed and who deals with it (my friend had 500). I've written about 6 letters (partly in response to their ridiculous responses that treat everything as an initial claim despite including reference numbers) and my boyfriend has phoned up a dozon times. Everything is documented and they didn't even get the data request within the 40 days. He's been with them for years and our wedding savings are sitting in one of their accounts also (I'd even made enquiries about jumping from HSBC so we can have a joint account etc). They really have made it so much hard work. Someone is due to call me back today at 1.20pm. He was very helpful on the phone but, as is often the case, he is not the decision maker and we will be told (AGAIN) that we'll get a letter back. I probably went OTT on the last call but coming back to two sets of Halifax correspondence but no letter re this is too much. They even tried to claim a couple of weeks ago that they had no record of charges post the beginning of 2006 (even though they'd sent him the statements)! And one of the call centre staff said they were only open Monday - Friday only which is a blatant lie!

    In short - my advice, if Halifax don't respond go straight to court - I believe Halifax are deliberately stalling so you settle low when they come back and I've wasted the last 6 weeks therefore - feeling it's almost not worth it (although perhaps that's what I'm supposed to think?!)

    This sort of service will surely put people off having a Halfiax account (it has me!) so if I don't get the response I should today then boyfriend is moving our savings and his account to HSBC and I am telling anyone who will listen about this including OFT and the FSA who I deal with re work anyway. Mind you he said that on Saturday and someone promised to call him back that day or failing that Monday. Had my phone on all day - nothing..........

    I have today sent the initial letter to Lloyds TSB requesting a list of bank charges for the past 6 years, but in my eagerness to get the ball rolling I have sent this letter directly to my local branch and not the Data Protection address's mentioned, does anyone know if this will make its way to the correct people or should I bite the bullet and send another cheque for £10 to the correct address ?

    You really shouldn't deal with the bank on the phone as then there is no record of what is said. Start the court proceedings.

    It will get passed on but I might be an idea to phone your branch and make sure they know what address to pass it on to.
