2nd Letter sent to Halifax Branch 31/01/07
Response from Branch saying they have faxed it to Customer Service Dept who will repond.
7 days up from tomorrow, do I give them longer to respond or carry on with the steps???0 -

Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
Halifax 2: Ongoing....0 -

You have given them a clear timelimit. If they don't reply (or say they will get back to you in X weeks). Just move onto the next step at your own time.How many surrealists does it take to change a lightbulb?

i had the same letter from them they said it would be the 16th i would hear my next letter was due to go on friday the 2nd feb but only got it sent recorded delivery today. so fingers crossed summit good comes out of it0

When you started your court claim, did you not fill in this section? It would have been part of the form you filled in.
If you didn't fill this in, I know where you've gone wrong, and how this can be resolved.How many surrealists does it take to change a lightbulb?

Hello
Having read Martins articles about bank charges, I am still unsure about the successfulness OR NOT of taking on the Credit Card people. Could someone please advise?

Hi again Rex, I see what you mean now. here is word for word on what was put into the particulars of the claim form.
The claimant has held a current account
with the defendant, conducted on their
Standard terms and conditions, The
defendant has applied charges to the
claimant's account, totaling £997.50. The
bank's charges are a disproportionate
penalty and therefore unenforceable.
Penalty charges are irrecoverable at common
law. The precedent for this was Dunlop
Pneumatic v New Garage [1915] AC 79.along
with Murray v. Leisure play [2005] EWCA Civ
963. The Defendants charges are also
contrary to the Unfair Terms in Consumer
Contracts Regulations 1999. Para.8 and sch.2
(1)(e)) The claimant has repeatedly asked
the bank to refund their charges or offer
proof that they are true pre-estimate. They
have declined to do so. The claimant claims
£975.50, being the sum unlawfully debited.
The claimant claims interest pursuant to
S69 of the County Courts Act 1984 at the
rate of 8% per annum, being the sum of
£193.33

It can't be that.
OK, here's another try. Phone the court tomorrow, give them your case number, and ask them to clarify your case for you. Explain that you don't understand what the judge is asking for. I've always found the court staff to be very helpful when you contact them.
From what you've said, you have done everything correctly. I can't work out what more the judge wants.How many surrealists does it take to change a lightbulb?
