Can anyone tell me how to sqeeze the letter template from Martins website entitled 'Particulars of Claim' into the box on Moneyclaim. You are only allowed 24 lines and the letter as templated does not fit into 24 lines. I do not want to edit it down as some important text would be lost.0

My mortgage company has charged me in the past £40 for a Direct Debit failure - does anyone know if I can reclaim this? Thanks0

i asked earlier, about natwest taking 8 weeks for official responce...
Now sticking to our time table, so moving to court action...
As my claim is for £5042, so just over small claims court amount of £5000. should i write to the bank first, saying we will lower claim, to about £4500??..
This way we can go to small claims....
Natwest realy trying delaying tactics.........0 -

Got a letter from first trust today in response to my claim saying the usual rubbish...these charges are not penalty/default charges blah blah blah.
had asked for
- quarterly tranaction charges incurred even if i was over for 1 day and a small amount
- mortgage redemption quote charges
- referral charges
- mortgage sealing fee (£179.04 in april 2005, mortgage held for only 2-3 years
- late payment fee on credit card.
they have said they do not feel they have a case to answer but are willing to offer me 50% i.e £47 of the fees they are willing to consider (referral charges & late payment fee). my request was for about £400 !!!!
dont think i should take this measly offer.
any advice/suggestions anyone?
thanks

I'm now proceeding onto the next letter threatening them with court action.
My questions are:
1. Since sending the first letter, they have charged me a further £165. Can I add this on to the total amount (as a revised figure)?
yes
2. They have taken charges out of my benefits. Should I do the seperate thing whereby I send them a letter telling them I have first "dibs" or wait until this proceeding is complete? Because I'm overdrawn (as they refuse to stop charging me, therefore a snowball effect has generated) and the only money going in is my benefit, how do I pay the charges off?
won't do any harm to do this now
3. I believe the bank has actually worsened my financial situation due to several factors. Where can I complain to?
I would wait until your claim is complete.
Help would be appreciated!
Thanks

You can but I presume that any money claimed will go to the collection agency to pay off the debt.0 -
any answers or help is much appreciated with this one.
I have recived a letter today from the courts (after having sent them my court bundle)
I've well and truly stuffed this one up. (although I thought I had included everything, I certainly followed all procedures off the last letter the courts sent me)
here goes. This is word for word on what the letter states.
"The district Judge has had sight of your trial bundle and makes the following comments: The lodged bundle does not appear to contain the statements of the evidence that will be given by the claimaint and any other witnesses nor does it seem to contain the statements of any evidence of any witness the defendants intend calling nor the parties skeleton arguments.
If we are wrong please direct us to the page nyumbers. Have the defendants served any statements, documents, or their skeleton arguement?
the court looks forward to your reply.
Well, to be honest I have only ever recieved 1 page which was in the way of a court allocation questionaire on which the solicitor of the bank sent to me, this is the only piece I have and this was included (or so I thought) in the court bundle I prepared. Could anyone please simplify the following to me so it's a little easier for someone who struggles to understand the court language.
Much appreciated.

Personally I would claim for the full amount. It's possible though highly unlikely that it will actually go to court so you have nothing to lose but an extra £500 to gain!"Think for yourselves and allow others the privilege to do so too." Voltaire.0
