"The district Judge has had sight of your trial bundle and makes the following comments: The lodged bundle does not appear to contain the statements of the evidence that will be given by the claimaint and any other witnesses nor does it seem to contain the statements of any evidence of any witness the defendants intend calling nor the parties skeleton arguments.
If we are wrong please direct us to the page nyumbers. Have the defendants served any statements, documents, or their skeleton arguement?
the court looks forward to your reply.
In very basic language.................The judge is saying that what was sent in isn't good enough. It doesn't state the reason for the case, or provide any evidence to back the case up. It is not only asking this of you. It is also asking the bank what they are on about and what they intend to do to defend this case in court.
To comment on your situation you need to give more background to your claim. What has happened so far since the court claim? What are the dates involved? What exactly did you send for your court pack? What has the bank sent in as their defence? What did you put as your particulars of claim? What's the date of your hearing? etc, etc.......How many surrealists does it take to change a lightbulb?

Hi
I'm about to make a claim to RBS, charges are about £650 but I went to the bank a few years ago and they refunded £100. I still want to make a cliam for the rest, but has anyone did this and what was the outcome. I was going to put this in the letter but just looking for advice.0 -
BenArd wrote:Ok, finally, after getting a couple of letters from the Halifax saying they had received the letter I sent and would issue a response by X date I got a fairly nice letter from them saying they were sorry to hear I had the hump and whilst their charges were correct they would refund me £472 as a gesture of goodwill. This was accepted (after a quick check on here) and i sent the form off to them on 22nd Jan. They stated that i would receive the money in 7-10 days. Checked my bank account and, surprise surprise, no money. I phoned the person who sent me the letter and after checking on his system he told me that the acceptance form hadn't been scanned in yet and so the money would not be refunded. He told me he would send me another acceptance form so i could resign it and return that to the department who process scanning things in (which is nowhere near were he is) and the process could be completed. On pushing he admitted that this would take another 7-10 days. Sounds like a simple delaying tactic on their part to hold on to my money for as long as possible. Assuming that i may well be faced with the same problem this time around (viewing it as glass half empty, or actually crediting them with enough brains to try and pull something like this off) is there anyway that i can put some pressure on them to return the money? i.e. as an agreement has been made am i now entitled to legally force the issue or should i just pay them a visit with a large stick:D

And it made me realise that many people are getting unduly scared if they get to this point - so i've amended the article to explain this a bit more (well I will amend it to say this tomorrow morning anyway!)
"EVEN IF IT DEFENDS THE CLAIM, DON'T WORRY. If you’re one of the few cases where the bank does enter a defence, don’t worry too much, this is pure posturing and in almost every case is simply a way to try and make you settle, or argue that you've asked for too much (e.g. you've gone beyond six years or tried to claim compound rather than statutory interest).
At this point you’re now in the Court process. There’s a straightforward form called the Court Allocation Questionnaire which you need to fill out and return to Court. The next stage should be a Small Claims hearing date, yet this virtually never happens, as the banks tend to offer a settlement at this stage. If you get right to this stage and want help, its worth using the further resources."

Generally no. You can only claim for the interest that bank charges alone are causing as part of your unnauthorised overdraft. Working this out from the legitimate interest that you can't claim can be extremely difficult.
- If you want to search a thread for any topic or word string, there is an option near the top of every thread. It's very helpful.Halifax WON! Claimed £1549 on 8th Jan 2007, Settled for £1350 on 29th Jan, Paid 7th Feb.
MBNA (Virgin / Alliance Credit Card charges): WON! Claimed £419 on 17 March, finally offered £425! on 5 June)
Natwest Credit Card: WON! Claimed £250, got 100% + interest + court costs too.
Northern Rock: Mortgage Discharge Fee: WON! Claimed £100. Offered £90 and accepted it.
Natwest Bank / RBS: WON! Claimed £400. Got 100% + interest + court fees back.
Halifax 2: Ongoing....0 -
Ok, thanks for that, do you think because I put these charges initially to the bank it will affect the claim, obviously I will leave them out on the moenyclaim. Thanks for your help
