  • I'm at the stage where I've asked for my charges back and the 14 day period has now come to an end. Halifax replied to my letter and said it would deal with my complaint in due course. I phoned them for an update and they said I could expect a reply by 12th February, but I'm not sure whether I should wait until the reply comes through or go ahead and post the letter of court action. I'm just so scared that I may stuff the claim up!! :confused:

    I'm claiming charges with interest totalling £3000

    Also, as I am in Scotland, should the court action letter say Sheriff Court instead of County Court?

    My situation is this: I have been unfairly charged over two bank accounts, to the amounts of £200 and £150. Not huge in comparison with others here, but it's huge enough for me!

    Problems: One account is a graduate account, and I am £1200 overdrawn. If I claim against this bank, might they demand I repay this?

    The other account is with a bank where I owe £2200 on a credit card, again, could they force me to clear this?

    I'm considering as some have done, in sending a polite letter to both banks as my charges are fairly low. But if this doesn't work, how hard should I push?

    Advice please!

    Don't know if anyone will be able to help with this...Basically I recently contacted Barclays to ask them for a copy of my bank statements for the last six years with a view to reclaiming the bank charges I incurred. Not only did Barclays fail to provide me with a copy of the statements within 40 days (which I think they might be obliged to under the Data Protection Act) they sent them to the wrong person!! I only found out about this because the person concerned was kind enough to send me a letter pointing out what had happened. Does anyone know how I can complain about this breach of the DPA? And also whether I'd be entitled to any more compensation?? Thanks.
  • Quick question - I am claiming for store cards, credit cards, etc. but is it also possible to claim for hire purchase?

    I bought a couch a few years back where you pay monthly and missed a couple of payments where I was then charged. The couch is now paid off in full but just wondered if I could get charges back on this also?

    So, if I understand, they sent your statements to another person.
    Although mistakes happen, this would be highly irregular but as the statements usually have your address at the top which is used viewed as the postal address.
    Is this definitely an error on the banks part and not Royal Mail (i.e. not just a similar name/address?)
    Does anyone know how I can complain about this breach of the DPA? And also whether I'd be entitled to any more compensation?? Thanks.

    The Data Commissioner deals with breaches. Not sure what you mean about 'more compensation', what compensation are you already getting?

    I have worked out all the unfair charges from HSBC, however in addition to this there are almost monthly charges that are termed 'Total Charges' and these range from £18 to £100..... although they are normally £25

    Can I claim for these too?

    I am guessing that these are charges relating to how many days my account was over the overdraft limit......

    What have other people done that have noticed this on their statements?

    dam barclays!

    they have sent the account i already claimed form statemants instaed of the credit card ones...... and i think have cashed the cheque..... what shall i do now?

    I have a number of friends who have successfully claimed charges, and am aware that I have to make the move, but I'm worried.

    I was in debt difficulty and signed up with a charitable credit counselling service who manage my debt payments to those who I owe, of which HBOS is one.

    My question is, if I make the step to start this charge reclaiming, will HBOS get annoyed enough to cancel the agreement they entered into with me, whereby my debt is currently being managed and thus not paid back to them in the manner which they would prefer?

    The daft thing is, if they gave me the charges, I could pay everyone back a little quicker!

    I'm just eager to establish the sensible thing to do.

  • Please can somebody confirm the cost of getting a copy of your bank charge. The £10 maximum that is detailed in the sample letter template, is this per statement if they send out the statements or is it a total charge. I have just spoken to Lloyds TSB and they have told me that a charge of £10 per statement will apply.

    You need to make it clear you are requesting under the Data Protection Act. The maximum charge is £10 in total for all of the information.
