    Hi Guys new to this site....

    i have been charged £50 for going £400 over my agreed over draft limit .

    this has happened a few times but i dont tend to keep my statements.
    am i right in trying to claim these charges back ?

  • What i need to know is, They want the full amount @£500+ to be paid to them any day now, otherwise they have stated they will take debt recovery action(i wont say which day cause im sure they would monitor this site and I dont want to give them any upperhand) .
    Should i pay this and then take the action by which time the account would be closed or refuse to pay the £500 and send for my statements telling them that i dispute the monies i owe them(would certainly be several hundred pounds and possibly enough to clear the whole overdraft).
    It has now become a principle to me and i totally willing to go the distance with it but just need the best way to proceed any suggestions kindly recieved thanks

    If you can I would pay the amount they ask and then start reclaiming your charges. Read Martin's article and start the process, nothing to stop you asking for the info/statements you require now as this can take up to 40 days.

  • Just had a thought about the £10 you have to pay to get your statments under the data protection act. If you did a 'subject access request' instead would this mean that you don't have to pay the £10?

    The request you are making under the Data Protection Act is a 'Subject Access Request'

    thanks for the reply and yes i will do that BUT i could do with knowing if £50 is the "acceptable " charge for going over agreed limit by £400 and i should only kick up a fuss if the charge was say £100.
    are we saying here that NO charge should be levied for this ?

    The bank is only allowed to charge you what it cost them and not a penny more. Even though you went over by £400, a £50 charge for this doesn't seem a reasonable amount. If all they have done is notified you with a couple of letters, the cost to the bank would have probably been much less than £5 in reality.

    Yes, you can claim off a closed account. For the other accounts, when you ask for your info, include all the account numbers you have with the same bank in one letter along with one £10 fee. If you claim for these, just put all the account numbers in the same letter, along with the joint total.
