    When a bank gives you an offer of payment. Where do they pluck these figures from. I have seen some really stupid one from say someone claiming £1000.
    I have seen £81.29 and £891.97. Whats the point in offering these total either dont pay anything or the whole lot. I think its just a randon figure someone thinks of.

    Also why do they sometime settle or at least offer something when only the first letter has been sent yet wait and are prepared to go to court with others. Again it just shows their inconsistancy.

    Could you use this in court as part of your defense. Out of all people who have requested how many have been settled either before and during court action. Then ask them what is the difference between your case and the others for them not wanting to settle.

    Hi All,
    I have just asked the Woolwich for all my bank charges for the last 4 years(748.00). I sent a letter on the 23rd Jan. I recieved a letter yesterday offering me 250.00 as a goodwill gesture. Of course I refused but offered them a goodwill gesture in advising them I would settle for 700.00. I'll wait and see. If they don't then I'll go all the way.

    Has anybody had problems recieving a list of charges from closed accounts? Abbey refused my request over the telephone and said they have not got those details on the system!!

    Any advice on what to do with this?

    Send them the SAR letter with name, address and date of birth as this means they have to provide them within 40 days.

    You write back to Lloyds and tell them you will now be taking them to court.

    Hi

    I have gone over my Abbey statements from 2002 and have listed all charges to the sum of 2399.19 excluding interest. My question is can you claim back charges on payments they allowed... ie. 30.00 for paying a visa transaction when the money wasn't available?

    Also can you ask for the whole charge back or just the difference of the acceptable charge.. ie. being charged 30 when the acceptable maximum is 12.. do you ask for 18 instead of the original charge of 30?

    Yes you can claim these £30 charges when they've allowed a transaction without funds being available.

    Forget the £12 maximum. You claim for the full amount. If the bank wants to justify this £12 charge, they have to go to court to prove their costs are £12 for every one of your charges (highly unlikely they can ever prove this).

  • This is for the attention of Rex Mundi.

    Please refer to your previous answer to my question on page 81.

    here are the answers for the questions you asked me.

    basically so far nothing has happened with regards to my court claim, I shall start from the begginning and hopefully this will answer all of the questions in one complete paragraph. (may I just thank you for your help so far before we go any further)

    I first wrote to Lloyds tsb in September asking for a complete list of statements on behalf of my wife's account which dates back 10 or more years. These statements arrived on my doorstep within the time required. My next course of action was to send them a follow up letter asking for the charges back, Lloyds again acted quickly and sent me a letter stating "sorry your not happy, and no you cant have any of the money back (or words edited to that effect). So my next stage was to file on moneyclaim on line and I payed the required £120-00 charge (I am claiming a total of £1350-00. This was all completed correctly. Lloyds defended this claim within the time scale agreed. I recieved a court allocation letter and filled in the relevant parts and sent this back to the parties concerned. shortly after this was done I recieved a further letter from the court saying that I need to prepare my court bundle for no later than 8th january and this must be received at the court and also the banks solicitors by this date. This was also completed within the time scale. I have never recieved a court date, only a date on which the court bundle had to be received. All of the information that was used for the court bundle was gathered from here and i even double checked that everything that should of gone in did. Since the court allocation questionaire I have not heard from the bank's solicitors. the only party I have heard from is the court. Then a few days ago the court sent me a letter on which you have already read. I am really worried now that I have blown it big time, I totally confused with all of the jargon that the courts use as their own personal language. Please help me if you can. Many thanks in advance.
