Just like to say that the questions and answers are great from the many who have joined the website.
One idea I was thinking of to make life a bit easier was maybe looking at new threads for each of the steps so that people can find questions to each step of their action with the banks.
So if someone needs help on step 3 of their claim then they woould be able to go to step 3 and ask for help or read other people replies.
Would make life a bit easier all around and people would then be able to go through the procedures with each step covered and backed by peoples questions and answers.
Not sure what you all think so will see how it goes from here.
Good luck either way to all the claims... do I need to sell my Lloyds TSB shares yet. lol0 -
I opened an account with Norwich & Peterborough just over a year ago as I was dissatified with the way Yorkshire bank was dealing with my account.
Initially, N&P were ok, but once I went over limit, they applied a charge of £29.50 and like all the other b******s they deied any wrongdoing and it took several letters to their chairman and letters to the FOS and BCSB before they did refund.
They increrased my overdraft without my asking, and this type of predatory lending and subsequent charges for upaid cheques led to them closing my account - and they still owe me £59.00.
I am still waiting for a satifactory response frm the FOS as well as the BCSB, but these people can't or won't be bothered to punish the banks so what use are they?0 -

The district Judge has had sight of your trial bundle and makes the following comments: The lodged bundle does not appear to contain the statements of the evidence that will be given by the claimaint and any other witnesses nor does it seem to contain the statements of any evidence of any witness the defendants intend calling nor the parties skeleton arguments.
The above letter from the court is saying your court bundle is incomplete, or not explaining itself very well. It is also saying the same about the banks defence.
In your court bundle, what did you include? No need to paste everything here, just an outline of what you sent to the court.
e.g............
A statement outlining your case including all the letters sent between you and the bank (including copies of letters they sent you)
The latest schedule of charges you are claiming from the bank
Copies of the statements that show charges
Relevent case law summary
Early day motion from the houses of parliament
A copy of Unfair Terms in Consumer Contract Regulations 1999
A copy of the Unfair Contract Terms Act 1977
A copy of the Sale of Goods Act 1982
What did you send out of the above list? How many surrealists does it take to change a lightbulb?

I am about to embark on reclaiming charges from Barclays in respect of a personal joint account. I have already set up a parachute account. However the Limited Company of which my partner and I are sole shareholders and directors is also with Barclays. Does anyone know if there is any danger that the Bank may try and close the Company account. I am hoping not as the Company is a separate legal entity0

You claim the full amount on all the charges (even if the charge is £12).How many surrealists does it take to change a lightbulb?

Hi,
What is a court bundle? Is this something that is sent seperate from the AQ form and if so at what point will it be requested/required by the courts?
I have not heard this term mentioned on many occasions.
Thanks in advance

This is the main paperwork you send to the court. The court will ask for it after the AQ stage when they need it. They give you a date to send it in by. This is the paperwork you will rely on in court to prove your case. It can also be quite a lot of paperwork (see the list I gave above for an idea of what should be included). A lot of people don't get to this stage if the bank settles. How many surrealists does it take to change a lightbulb?

Hi There!
I am currently in the process of claiming from Mint for my credit card.
I was due to send them the "threatening court" letter on Friday which I did, but then on Saturday morning, I received a letter from them which said the following:
"Thank you for your letter. I am sorry you have felt it necessary to bring your concerns to my attention however, your feedback is welcomed and I thank you for this.
From review of your letter, I am assuming you are referring to the statement published by the Office of Fair Trading (OFT) regarding charges. MINT has always been committed to ensuring that customers understand our charges and fee levels, which previously applied. These were clearly and consistently communicated to our customers as part of our published tariff of charges.
Although the OFT produced a statement on 5 April 2006 concerning the nature of these charges, we do not accept their finding in respect of credit card fees. Although a response has been submitted to the OFT, I do not feel it pertinent to comment at this time. Whilst strongly disagreeing with the findings MINT has lowered the fees charged to £12.00 as of 28 June 2006. However, we do not feel claims for monies processed prior to this should be refunded.
The charges were processed in accordance with the terms and conditions of the account of which you agreed when opening the account and I do not feel your comments surrounding any unlawful action, on behalf of MINT, to be justified.
Your file will remain open until 29 March 2007 to ensure you have sufficient time to consider the above. If you are happy with my letter, you do not need to do anything else and on this date the file will be closed.
If for any reason you still have concerns, I hope you will give me the opportunity to address them by contacting me. If however, you remain unhappy you can ask the Financial Ombudsman Service to look at your case."
Are they just trying to put me off or are they correct. I just don't understand that if they are right with what they are saying, then why would so many other banks pay out on credit card fees if they didn't have to. Also I have read on the success board that a few people have claimed from Mint for cards.
Just wondered if anyone had received this same response from them and what happened?
Thanks0
