    I've read lots of other posts about people's dealings with HSBC and am worried because I don't seem to have had the same response from the bank as others. When I sent the 1st letter off, they didn't reply saying they were looking into my case, (like most other people have reported) but instead asked for a list of charges, (even though I had sent a list with letter).

    Now it has been a week today since I sent 2nd letter and haven't heard a dickie bird. I don't know whether to give it til Monday before I go onto the Moneyclaim site. I'm rather frightened about the whole thing now!
    What would you do?

    the story so far.........................

    29/12/2006 sent letter for statements
    06/01/2007 received statements
    06/01/2007 sent letter to reclaim charges of £1889.00
    15/01/2007 received standard letter "open and transparent bla bla no refund sorry"
    17/01/2007 sent off pre court letter
    28/01/2007 filed claim at mcol
    31/01/2007 acknowledgment fo claim
    02/02/2007 court papers received with intention to defend claim
    02/02/2007 letter off nationwide:::

    thankyou for your letter of 17/01/2007

    i am disappointed to learn we havent been able to resolve your complaint to your satisfaction at this stage.

    as the nationwide group uses the fanancial services authority rules when dealing with customers concerns, i am now refering your case to our member service department for them to review under the complaints procedure.

    member service will look into your case and will provide a final response on behalf of nationwide. if you are still not satisfied afetr recieving there reply, you may then approach the financial ombudsman service for an impartial and independent assessment of the situation

  • don't panic rodster. Just because they have filed a defence does'nt mean they will acctually defend in court. They are probably just puffing their feathers hoping you will back down. There are a couple of solicitors Ive seen somewhere on Martins website who are offering to work on a no win no fee bassis. Might be worth contacting them. Good luck and keep us posted. Gary
  • I'm at the stage where I've asked for my charges back and the 14 day period has now come to an end. Halifax replied to my letter and said it would deal with my complaint in due course. I phoned them for an update and they said I could expect a reply by 12th February, but I'm not sure whether I should wait until the reply comes through or go ahead and post the letter of court action. I'm just so scared that I may stuff the claim up!! :confused:

    I'm claiming charges with interest totalling £3000

    Also, as I am in Scotland, should the court action letter say Sheriff Court instead of County Court?

    Standard letter you carry on with your next step. Yes its the Sheriff Court.

    Well I FINALLY got my bank statements through from Halifax.....all 153 pages of them. :rolleyes: It comes to £640 plus £137.59 interest, making a grand total of £777.59. :eek: So I am going to send the initial letter off - wish me luck!! :j

    Hi everyone

    Can anyone help me with this query? I have recently paid back a debt that was sold on by the original creditor to a debt purchase company (a very 'low' profession in my view!). Given that all rights to collect the debt are assigned to the new owner, then presumably any claim for unfair penalty charges should also be directed at the new owner too, rather than the bank that imposed them in the first place..?

    Any thoughts?
