You can't claim interest charges back, only charges. You can claim stat interest on the charges though, but you are only entittled to this if/when the case goes to court.
I am currently claiming £550 (including interest) from Cahoot. And they have take the hardball approach. They have submitted a defence stating the usual. But what shocked me the most is number 8:
"The fees reflect and are proportionate to administative expenses incurred due to the claiments breach of contract and are a genuine pre-estimate of the DAMAGE suffered by the defendant"
Amazing, seeing as Cahoot don't even send you a letter to tell you about the £30 charges, but instead send instant message sent to my "cahoot message centre"
I can't wait to see how they plan to prove that to be true!

had they already offered you an amount or did they just say no?0 -
Well if you all want to feel any better my interest charges were near the £3000 mark and what I am claiming is £959.45 with interest as in the guidlines.
So in hindsight, no more banks for me.. cash only from now on.. Lesson learnt the most expensive way......

They sent me a long email.... saying No.... no offers or anything. Because they took so long to send it, I had already raised a court action by the time I was reading it.
Will have to let the courts decide now.

Amazing! I am in the same situation with cahoot and their hardball approach. Just having received their rather snooty and dismissive email I am prepared to take it to the court claim stage. It was widely held on this forum when I posted their wording from the email to be an admission to using charges to fund all overlimit accounts not just yours. This is not right at all - how can the law stand by that as a defence??!!
(This was Rex's comment) 'The reply you have been sent is a godsend for you (and a mistake on their part). I think it must have been written by someone not dealing with these claims, they have handed you (and other Cahoot customers) a fantastic point for your case in court.......
I appreciate the points you've raised in your letter and can confirm that the charges levied contribute towards our costs for administering delinquent and overlimit accounts.'

Received my statements back today (day 29) from the alliance & leicester.
Got straight to work on the tallying up, to my amazement the final total is £2368.50 + £314.16 interest.
Anybody had any experiences with the A&L?
