    I have been with HSBC for over 20 years now. and it has only been the last few years that I have struggled a bit financially and gone over my overdraft. My overdraft limit is £1000 and i have gone over by no more than £100 a few times lately. I am worried that if I request a refund of charges that they may ask me to pay the full overdraft back, which I cannot do!! has anyone had this happen to them

    It is the same process for both. I asked the same question some time ago and i am currently doing it with Capital One. If you look through the posts there are several people claiming through credit cards

  • Hi. completely new to all of this so find it daunting.
    I went bankrupt between christmas and new year with the majority of the debt to the halifax. Having banked with them since school, some 12 years i know they have had thousands of me in charges. Is it churlish to try and reclaim these considering the bankruptcy or will any refund awarded be immediately swallowed up?
    Any help or opinion would be appreciated. Ta.

    All banks can and some do, close account and/or call in an overdraft. It could be what you claim may go some way to paying off your overdraft as they will expect to pay any reclaim into your account.

    HSBC *generally* don't tend to close accounts after the first claim, but other peoples experiences are somewhat irrelevant, as they could start closing accounts today. You must ensure that you have the necessary fall backs in place should they call in your overdraft.

    I would stick to the process. Either claim for interest from the start, or leave it till the court stage. If you start off on your own course with your own ideas, you may end up in a sticky situation, and could ultimately damage your chances of success. The process as set out works, why change it?


    Thanks - it was just the unauthorised overdraft and referral fees I am proposing to claim. Not going for the interest - their attitude to date has been quite fair (perhaps a tactic, but you take as you find), so I would be happy with the reimbursement of the full charges. As you say, if they don't play ball and it goes to court action then I will rethink on the interest issue.

    Am just about to send my second letter giving 7 days before I start Court Proceedings but can't find my copy of the charges that I printed out using this sites calculater plus interest.
    I received a letter from them on saturday saying that they are considering my claim so I know they received the first lot of charges that were printed out.

    What should I do

  • Today's the day I file my claim, I am doing so online now.

    What address do I put in the defendants details?

    The infamous Mr C Langdale at the Arlington Business Centre address, whom all correspondence has been from, or their registered head office at Canada Square?
