Reply came from a Customer relations manager.

See above post; banks are writing 1000's of letters with the phrase 'complaint'.

I'm sorry you went through the BBC website as I'm not convinced that their advice is the best and certainly not as good as Martin's article and the advice given here.

They wrote back sayin their charges were in the standard Terms and Agreements blah, blah and offered me £895. I wrote back rejecting this and offering to accept 80% of the total amount. I didn't hear from them in over 2 weeks so I have filed using the online Moneyclaim system. What I would like to know is if the fact that I have estimated charges will prejudice my case? If the total is lower than my estimate will I lose the case if Barclays choose to defend? Any advice would be appreciated as I am a little worried about the whole thing.

Probably not what you want to hear but I would think that the bank will certainly enter a defence and I have no idea what advice to offer you now.

I am claiming £3307 without interest from firstdirect, just had an offer today for £2340. Which seems a little low.
Couple of questions. I have closed the account with them, but still have an outstanding overdraft with them, which i have an agreement to pay £170 a month off to clear it. On the proposal they have sent me they state that "....the funds will be credited to the above numbered account to reduce the outstanding balance." Does this mean they will refund charges, but only to pay off what i owe?? Can they do this??
If was was to push for more ie. court letter, what sort of time scales would it be?

hiya!! How are all of you doin this?? Do you have to go through a certain company? or somebody? It sounds pretty scary to me bt the bank have charged me soooooo mch in the past 6 six yrs its not even funny in one monh they charged me 90 quid!! as im completly not wif this please cold someone show me where to start? thank you very muchTotal debt £17,135 total paid off £5250

Hi Dezzi! At the top of the page you will see links to the FAQs and also the template letters to send. You don't have to go through a company and unless your claim is really complicated you don't need to seek legal advice. The steps are basically:
1) Send out Subject Access Request for your statements. You pay a maximum of £10 for this so DON'T listen to the bank if they try to say you have to pay more.
2) Figure out how much you are due (spreadsheets available) and send them a first demand giving them 2 weeks to reply.
3) Even if they reply saying they'll get back to you sometime before the Second Coming, send out a second letter informing them that you will take them to court if they don't give you them back within 7 days.
4) File your claim with the courts. I know this sounds scary, but very few end up in court. Most banks will acknowledge the claim before the 14 days are up, and then give you the full amount before the end of the 28 days they are allowed. You also get to claim back 8% interest at this stage which normally bumps your claim up nicely!
Most of all, stick to your own timetable and don't back down. Don't accept 50% offers or anything ridiculous that they will try. Good luck!"Think for yourselves and allow others the privilege to do so too." Voltaire.0
