No idea I'm afraid but have a read of Martin's new article regarding the exit fees for mortgages, there might be some "help" in that although do be aware this is about exit fees.

Ok, finally, after getting a couple of letters from the Halifax saying they had received the letter I sent and would issue a response by X date I got a fairly nice letter from them saying they were sorry to hear I had the hump and whilst their charges were correct they would refund me £472 as a gesture of goodwill. This was accepted (after a quick check on here) and i sent the form off to them on 22nd Jan. They stated that i would receive the money in 7-10 days. Checked my bank account and, surprise surprise, no money. I phoned the person who sent me the letter and after checking on his system he told me that the acceptance form hadn't been scanned in yet and so the money would not be refunded. He told me he would send me another acceptance form so i could resign it and return that to the department who process scanning things in (which is nowhere near were he is) and the process could be completed. On pushing he admitted that this would take another 7-10 days. Sounds like a simple delaying tactic on their part to hold on to my money for as long as possible. Assuming that i may well be faced with the same problem this time around (viewing it as glass half empty, or actually crediting them with enough brains to try and pull something like this off) is there anyway that i can put some pressure on them to return the money? i.e. as an agreement has been made am i now entitled to legally force the issue or should i just pay them a visit with a large stick:D0

Had a reply from Capital One saying that basically they sent me a credit card agreement when I opened the account and I agreed to these "fees" but as they have recently reduced their charges to £12 from £20, they are happy to reduce all fees I have paid to £12.
I was originally claiming for £268 but they have now offered me £115 as a gesture of goodwill :mad:
Any amount would really help me out but do you think I should contact them and say if they put their offer up to £200 I will accept but if not I am carrying on with my claim?

I have two bank accounts with Lloyds tsb. One used to be a joint account but now a sole account. One account Lloysds closed because of my defults. So i only have one account open with them. I have wrote to ask for information all all my charges for both accounts and they will obviously have this info still for the closed account and they will still supply me with it, but can i still claim back the charges plus interest on the account that is now closed?Claiming against Lloyds TSB

I, like everyone else here, am in the process of claiming charges back from Barclays. Following the standard templates given on the BBC website, I wrote to Barclays claiming £6000. As I have no bank statements, I worte that the amount stated was an estimate over 6 years and if they disagreed, to provide evidence as per Freedom of Information. They wrote back sayin their charges were in the standard Terms and Agreements blah, blah and offered me £895. I wrote back rejecting this and offering to accept 80% of the total amount. I didn't hear from them in over 2 weeks so I have filed using the online Moneyclaim system. What I would like to know is if the fact that I have estimated charges will prejudice my case? If the total is lower than my estimate will I lose the case if Barclays choose to defend? Any advice would be appreciated as I am a little worried about the whole thing.

I have recently done axactly the same thing Capital One and had the same letter back. I was not happy with the settlement and i asked the same question you have. You can persue this in the same way and push for the full amount you are asking for. I will be doing this and not accepting there offerClaiming against Lloyds TSB

Ok I'm really panicking now...I've got a copy of the defence from Barclays and it states that i didn't provide details of the account in question or the precise charges alleged in the court particulars...Have I messed up? There isn't room to list all the charges on the form surely...
It also states that they fully defend the claim and also says that any charges alleged to have been applied to my account beofre 29 dec 00 won't be recoverable due to exhaustion of time...Did they just not read my letters or is this a standard defence. My first charge is in May 2001. I'm worried that I'm goin to forget to do something or write something down in my allocation questionnaire that will mess it all up. I've read the allocation questionnaire bit telling me what to put but I'm still dead worried that I'm going to have to go to court.
dO i HAVE TO SEND A COPY OF MY ALLOCATION QUESTIONNAIRE TO BARCLAYS?
If Barclays offer me a settlement before court is it likely to be the full amount of charges plus interest plus court fees as would be the case if I won in court? Or will they just offer me the charges money?
