    This has been going on since February 15th.
    I have finally got my court date which is 17th August (they obviously very busy).

    Has anyone had any dealings with HSBC at this stage.
    When can I expect them to give in and pay up?

    I am claiming for £3666 (inc interest) + £220 court costs + daily interest at 68p per day!

    D & G Solicitors asked me for a breakdown months ago, but have never got back to me?

    How do u get cash off Studio? What do they actually charge for? I know they charge a 'service charge'. I have an account with them and if I can get some cash out of them it would be fab.

    Not sure if this is the right thread but here goes.

    I am currently at step 3, I have written to the bank asking for my money (£4800) back.

    I received a letter today stating 'the Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contract Regulations don't apply to me as I'm a business customer'

    Can anyone veryfy if this is correct please.

    Reclaiming on a business account is different to that of a current account. The business account thread for this site is here:

    but does anyone know the english address i can put down on my claim for HALIFAX CARD SERVICES i only have address in fife which i cant put down on mcol

    You could try sending it Halifax complaints, they should then forward it on to the relevant department

    David, in the eyes of the law, if a penalty charge is incorrect, illegal etc, the bank is still obliged to answer how it arrives at such a charge

  • I have just rung the halifax, and I have had it confirmed that they have changed their procedures, they have said that after the 8 weeks they will now be declining offers this is in an attmept to stall for more time, you must take court action in order to receive your money.:

    Hi all

    I sent the threaten to take it to court letter and received offers from mbna and barclays both of which i am not happy with. Some questions:
    1. should i start mcol straight away
    2. do i need to inform the banks that i have filed my claim with mcol or do the courts send a letter
    3. when sending a letter declining their offer should i put the date that i filed with mcol

    Oooh...starting to get the jitters now, but am determined to see this thru.

    I have a claim that was placed with MCOL for a total of £8134 plus interest against First Direct. After reading a lot of the threads about FD on here, it seemed to be a simple case that they would fold quite quickly. But they are really upping the ante now.

    The date when I was due to be able to claim judgement was 15th May. However, I have checked with MCOL today and the claim has now been passed to my local court. Therefore, I cannot continue any further with the claim online.

    I've not received any court papers yet so this must be a very recent development. I presume I now have to wait to find out the court date.

    What is starting to bother me is that the amount could mean that it is not put to a small claims court. However, knowing that not one bank has yet turned up in court to defend such an action is very comforting to me. Even if this goes to a higher court than small claims, I am still determined to see this through. I guess I am in the fortunate position in that I can afford to go to court. But it still gives me the jitters but is also strangely exhilirating.

    I'm still hoping to hear from FD's solicitors offering a settlement (which I hoped I would have had by now) and I am still convinced that they are just trying to scare me into backing down. But it won't work and the stubborn streak in me is coming to the fore.

    Keeping my finers crossed and will be sure to let you know the outcome. I don't think it will happen, but I really don't want to be the ONE that really does have to face a bank for the first time in court LOL
