    Did you send the template on the site? If you did then your instruction would have been clear.

    As far as I am concerned they have 40 days to comply to your wishes.

    Telephone them and remind them what you expect and that you look forward to receiving it within the original 40 days

    If the 40 days is almost up you may wish to say you are giving them an additional 7 days but then you will refer the matter to the Information Commissioner

  • I am hoping someone can offer me some advice. After issuing the final letter of 'I'm unhappy with your response....sort it or I'll take you to court. to Halifax credit card (they declined my first letter) for £668 without interest although I have claimed with totalling £774.20, I have today received an offer of £310 saying they won't pay any interest or the charges x4 of the current fee of £12.
    I called and advised the 'lady' I won't be accepting their offer as its less than half of my claim to be told 'well I take it your going to make a court summons, you might as well cos you'll be waiting ages for them to review your claim again'!!!!!
    My biggest problem though is that the acceptance slip states in really small writing that they will only pay into my credit card which kinda defeats the object of me gaining some cash. Is there any way around this?
    Any advice would be greatfully received.:eek:

    just got a letter from halifax, saying that they are sorry if i feel this way, and i did agree to the terms and conditions, and they would not be doing anything, in other words, f**k off.
    i have just printed the other template letter, saying i would be going to court if the do not respond within 14 days, any advice on wot you think they will do, im really scared now, dont wont to go to court.£2960 claimming.

    It's yet another bluff by the Halifax. You will not have agreed to the terms and conditions for charges that are unenforceable.
    Write to them saying that you want a full breakdown of the charge (£35) or whatever the amount. If they fail to provide that information, you will request the court requests it. Advise them you are proceedding with your claim.

    Will they give you the information ... NO because they don't want you or anyone to know. Rest assured that this is a Halifax bluff but yours is not

    I am new to this.
    I have recently sent my letter asking for statements from the past 6 years, its been 5 days and no reply yet! I bank with HSBC.

    This morning though I have had a summery of my bank charges and interest for last month, but I also had a letter enclosed concerning (as HSBC put it )Our 'Fair Fees' Policy.

    As I have been going over my overdraft limit frequently the past months, they are putting (as HSBC call them) Arrangements fees onto my account each month, like this one I had this morning for £125.

    I am still entitled to claim these back? It is only recently HSBC have been calling the charges Arrangement fees and it is the first time I have had an extra letter with the 'Fair Fees' policy on. It has confused me!

    PLEASE CAN I GET SOME ADVISE!!!! :confused:

    It would be helpful to know which Bank this is as you'll probably find within these posts someone who has got money back from the same back.

    Ask them to show you where within their terms and conditions are they entitled to charge amounts that are unfair according to law and are unrecoverable. Re you being In Scotland, there are links on this forum relating to Scottish Law.

    You can write to the Financial Ombudsman and withdraw your complaint advising that you will be pursuing the matter through the small claims court.     The time it takes to complete this process is fixed in part, such as, it takes:
    5 days for the claim to be served
    14 days for the bank to acknowledge and state intention to defend
    14 days to actually defend

    The time it can take to get a court date depends on how busy the court is basically but many cases do not get this far and are settled to the claimants satisfaction before this. Either way you are looking at a lot less than the 6-9 months quoted by the FO. Good luck :)

    Just calculated my claim £1100.00, after recieving my copy statements yesterday, do i use the same address that i used for getting the copies in the first place, to now ask for it? its barclays bank? please help?? x

    You might like to ask when and where you agreed to Arrangement fees.
    A court will quickly see that they are applying a new name to the old problem. Whatever they wish to call it, the charges are not acceptable in law.

    Shame on HCBC in their feeble attempt to confuse and disquise the issue.

    CONTINUE WITH YOUR CLAIM ...... Judges are currently sick to death with these banks and such deception will be deeply frowned upon
