  • I have also received a letter from the Halifax this morning after waiting 7 and half weeks declining my claim, I rang them straight away to be told they would look into it again but it would take another 2 weeks, I told them I thought it was just another delaying tactic and I have now had to claim on line to the court. I am really nervous just in case they see this through all the way and I end up with nothing HELP!!!!!

    please can someone help.
I have been really stupid. I started all this back in the beginning of Feb, being ignored up until the MCOL thing. Then, on the 14th day the bank (Natwest) said they were defending, so got another 14 dyas. Then I got a copy of their solicitor's defence (which was basically 'why is it unfair' and 'proove that you were charged these ammounts' etc etc. I then got a letter from MCOL telling me that it had been referred to the local county court and to reply to the court manager. I wasn't sure what I was to reply to, so checked this site, and the other's recommended, and presumed I had to send proof in bundles, quoting the laws, and including all statements and correspondance etc. It took me hours ansd hours to scan everything and copy them, one for the bank's solicitors, and one for the court. I was told an allocation questionnaire had been dispensed with, so was very confused, but struggled through and thought I had covered everything. I sent these bundles off by recorded delivery, on Tue but have just checked the letter I received from MCOL and it doesn't actually tell me to do anything, just that if I need to respond, that i should respond to the court manager. I have got confused and thought the part that said I only had until the 9th May to reply with the information requested was from the court, but it wasn't...it was from the bank's solicitor. Have i jeopodised my case now, by sending all thhat irrelevant information, I have a feeling I should have waited for the actual judge to get in touch, and am now worried that by sending all that information before being given a hearing date or instructions that it might be 'thrown out'. Any help or advice (but preferably reassurance) would be very much appreciated as I have been so patient, and up until now I have followed everything to the letter, and am very worried it has all been for nothing.
thanks for whoever takes the time to read all this, I know I have gone on. Sam x

Hi, Just ignore their timescales & go with the ones it says on the templates, 14 days for 1st letter, 7 days threatening them with the court action. Hang on in there, you WILL win.Good luck, SUFC

    Can anyone help me??
I had an Adams store card a number of years ago that was issued by CREATION FINANCIAL SERVICES. I know that Adams the childrenswear company has recently gone into liquidation. Has anyone had any dealings or success with Creation? And am I still able to claim fees from them if Adams has gone into liquidation?

Can i recommend that anything you are intending to mail to your bank be sent by recorded delivery? OK OK so it will cost a little bit more but at least you know it will get to where it is intended to!

Posting via normal route or sending in by hand and the item may disappear by mistake? take it from someone who has been down that route! all important mail i send goes either recorded or special delivery!

the number of my claim. The Court said they had a backlog.I would appreciate advice from other people who have issued Warrants of Execution to be similry met with silence or success.

How much are the balifs, and do we get it back.

Martins advice has been great so far, but it stops at the warrant stage, and leaves us without a clue.

Anyone know another site, which contains the extra help needed?
I'd suggest you get back on to the court to find out exactly what is going on in your particular case and get the information you need from the people who are actually dealing with it. No doubt there is a backlog to be dealt with.
