Hello everyone. I have read a fair bit in these forums but I feel a bit unsure as to what to do next so I thought I would post. I sent off the first letter to the Royal Bank of Scotland to get a copy of my statements which they sent back to me. I then sent off the second letter asking for my charges to be refunded (including interest amounting to 600 pounds) and they replied with a letter stating that they are looking into it and will reply soon. I then waited the 14 days and sent the 3rd letter out threatening to take it to court. I then received a letter yesterday (today is the 14 day deadline) saying basically the same thing - that someone is looking into it and will get back to me.
Do I go on to the final step now and put a claim in? I am in Northern Ireland so I assume that I can go to the online court for Northern Ireland mentioned in the main article? I'm not sure whether I should wait to hear from them as stated in their letter?
Please reply as soon as possible so I can make my deadline!!!

You dont have to wait for them to bother to reply denying your claim or making a low offer of settlement and can now file claim at the online court for Northern Ireland, yes. Good luck0 -
hi can anyone help me? i received my bank statements today yippee i should say lets get moving!! no! they have sent me from 2006 to todays date also none the the statements have any bank charges on?? what should i do ring them? send the letter again. any advice would be grate thank you debra.
Its likely the bank is sending the details out in batches and you should receive 2004-2006 next and then the pre 2004 archived material after that. It is the most frustrating part of this reclaiming process and all you can basically do is wait. You can report them to the Information Commissioner if they delay past 40 days in sending this data and write and advise the bank you intend to do this. It may hurry them up a bit.0 -
The same happened to me - had an initial response saying that they would reply within 4 weeks, then received another letter once the 4 weeks was up stating that they needed another 4 weeks, by which time I had already filed the MCOL - not sure if I have done the right thing, but fed up with waiting...0

I am currently claiming unfair charges from Barclays for my son to the tune of £2,900, however, he does owe the bank around £800 which we will not pay until we get some positive feedback from them for the overcharging over the last six years. Today we received a summons to attend court two hundred miles away from where we live. Obviously, we are counter claiming against Barclays. Has anyone any advice how to tackle this? :money: :money:0

I sent letter 1 from the templates to the halifax requesting 6 years statments on 03/03/07 on the 18/03/07 they cashed the cheque, goody i thought things are moving alone quicker tha expected, However 23/04/07 still no statments phoned the bank who denied having recieve the letter(this was recorded mail and signed for by the bank), I pointed out they had signed for the letter and they still denied getting it I then played my trump card
me:
"but you cashed the cheque and the letter was in the same envolope"
bank clerk :
" oh erm let me check.........erm well, yes the cheque was cashed ..... erm.....no request has been placed on the account for this information, i'll place a request now"
me:
"can i expect the statments next week then?"
bank clerk:
" no it will take another 40 days from today"
after reading her the riot act i advised her i would not wait another 40 days and told her i would be sending another letter to the bank demanding this info in 7 days and a copy of the letters to the information commisioner.
has anyone else had this problem with halifax or any other bank0 -

Without doubt, Judges around the country are very disturbed
how the banks are wasting court time on "no shows"
What is now required to set a precendent in County Courts is ....
If a bank advises the court they will defend the action and they do not
appear then a heavy fine should be levied against the bank for wasting court time.
This will either force the banks into court and of course then they will be required to explain in detail the breakdown of their charges ... OR, upon you issuing the summons they simply pay up (as they are going to do anyway)
and not attempt to defend themselves.
This is a "catch22" situation for the banks, either pay up or expose themselves which in turn will open the flood doors for everyone.The Winner Takes it All0 -

Firstly, reply to the court and request the hearing is in your local court, they will transfer it.
In the meantime, suggest you write to Barclays and acknowlege receipt of the summons and tell them that you intend to ask the court for a complete breakdown of the unfair charges over the last 6 years.
If the summons came to you after you made the claim, it could be said that Barclays are retaliating and intimidating you. This should be reported to the FSA immediately.
PS: If this actually does end up in court, that's if Barclays wish to expose themselves, it's a simple case that the £800 came about because of the unfair charges.
It is possible that Barclays is another of these banks where the left hand never talks to the right hand. Meaniing that whatever dept issued the summons does NOT know about your claimThe Winner Takes it All0 -
