    as i will be filing a claim tomorrow, do u think i should ring up abbey and just say as i have not received anything from you i will be claiming? it might make them settle over the phone???

    Presumably you've already sent them the letter threatening court action? If you have, I don't see there's any need to ring them ... could make you seem desperate (even if you are:rolleyes:). It's probably more advisable to keep everything in writing ... there won't be a record of your 'phone conversation if you need to refer to it.

    They'll settle before court anyway and, if you do everything to the book, you're much more likely to get your full amount.icon7.gif

    I am reclaiming from Clydesdale through the FOS. I sent first letter on 3 March, second one 2 weeks later, got standard replies then went to FOS. last week I got a reply from Clydesdale saying they were having trouble tracing my account and if I sent them a bank statement they would issue me with a cheque in settlement. So I sent it off and this morning they have sent me a letter stating that although it is now more than 8 weeks since my initial claim they require a further 8 weeks to investigate. Do you think this is just a standard letter they send out or is it in response to me sending the bank statement as requested?

    Still no word from Lloyds.

    Totally random question, not a reply to your message.

    Im totally new to this whole site and forum. I have a quick question though, looking for similar experience or advice??

    I put my first letter in with TSB in Feb and have only just received a settlement letter today. The thing is the letter is dated 23rd April and they are offereing £750 as a gesture of goodwill in full and final settlement of my claim and will be credited within the next 10 days. I have checked my acc and they have credited the money today.

    Only problem is they owed me £3,000!! No-where near £750!!

    Ive tried calling the ''claims helpline'' telephone number on the letter but cannot get thru to a human and the option of leaving a msg is a complete no no as the ''mailbox'' is full!!

    What can i do now as i have been waiting on this money since Feb and havnt had the opportunity to accept or query the amount due to them not posting the letter out for 15 days!!

    [ The total amount i am claiming is just short of £4,300 with £1073 interest and £250 court fees. I have been informed that the allocation questionnaire has been dispensed with. there is a list of items i need to to forward to the court and the other party. such as copies of all documents.     Hi,

    I've sent off my letter asking for my charges back and giving them 14 days to respond on the 10th April

    They did respond on 16th April saing:

    "Thank you for your recent letter regarding charges applied to your accound. We are currnely considering your claim and will reposnd to you as soon as possible"

    Now - how long should I give them? Should I go straight in with the court letter? Or send another letter asking them where they are up to with the case??

    All views/help greatly received!!!

    From what i have read on here a few people have had the same problem, i found this on here it may be of some help. :) - Good luck

    This has been posted before - hope it may help:
    Just change the XXXXX to your info!!! Its very important you use these words - part payment without prejudice from what i have read!!

    Thank you for your letter dated XXXXXX. I am writing to inform you that I accept the money that you have refunded into my account as part payment without prejudice but that I intend to proceed with my claim for the full amount.
    You may not have been aware that I commenced legal action against you for the full amount plus interest and costs on (enter date) and I would ask that you now refer this matter to your legal department for further instruction.
    Alternatively, should you wish to settle my claim in full, then please forward the balance of the claim (enter amount) plus interest without further conditions and I will inform the court that the claim is settled.
    Please note that the amount refunded to my account as of todays date is (enter amount).

    Hi,

    I sent my letter to Lloyds back in January and got a response within a week or so stating that they will not pay back my charges. I've not been able to afford to got to court until now, will that cause me any problems? Do I need to write them a letter again?

    Also, are Online bank statements enough proof of the charges, or must I apply for copy statements?
