Now - how long should I give them? Should I go straight in with the court letter? Or send another letter asking them where they are up to with the case??

    Stick to your timetable!

    Hi,
I'm sure I have seen this question before but can't remember the responses to it.

I have just sent my third letter (the one threatening court action if they don't pay up) and in the meantime have just incurred another £39 charge as a £10 cheque bounced and I only had £5 in my account. Oops absent-minded me, I am pants with money hence I'm claiming over £1,000 from Halifax!!!!! Can I simply add this to my claim, which I will file with the court soon, or will I have to go thru the whole process again from the start to claim this £39 back??

  • as i will be filing a claim tomorrow, do u think i should ring up abbey and just say as i have not received anything from you i will be claiming? it might make them settle over the phone???

Its worth a last ditch atempt but I wouldn't count on it. They only seem to be taking anyone seriously when a claim has been registered with the courts against them.

Try it anyway - you never know!!!!

I was at the money claim stage. Today was the 28th day as they acknowledged. I went through the process that they have not responded. I had to stop mid way through about stage 3 and come back. When i did the status was halted and they have put a defence in on the final day over what i did. Can they do this?
As far as I know they have until the close of play on the final day (usually around 16:00) to submit a defence. If the final day is a weekend, the final day moves to the next working day (Monday 16:00). Try calling the court, they may be in a better position to answer
  • Anyone know? :confused:icon7.gif
I think they are defo fobbing you off and using bog standard delay methods. Stick to Martin's timetable as they only seem to be taking any notice when a claim against them is logged with the courts.

    Hope this helps

    Hi,

I've sent off my letter asking for my charges back and giving them 14 days to respond on the 10th April

They did respond on 16th April saing:

"Thank you for your recent letter regarding charges applied to your accound. We are currnely considering your claim and will reposnd to you as soon as possible"

Now - how long should I give them? Should I go straight in with the court letter? Or send another letter asking them where they are up to with the case??

    All views/help greatly received!!!

Stick to Martin's timetable and either go with the third letter (warning of court and a further 7 days) or start proceedings against them with MCOL, and no further warnings!!!

    Hi all

Can someone answer this for me.

Sent my first letter to several of my old banks and credit cards.1st letter

Had a letter from MBNA today (the 14 days is up a week today) saying they are looking into my complaint and will give me a response on the 24th May.

Now are they allowed to do this or should they be playing my my rules ie 14 days.
Do i ignore this and send out the 2nd letter saying their response was unsatisfactory??

    Any advice appreciated

    Ta, Melissa xx
