Reclaim Unfair Bank Charges Discussion Area

HI,
I've recently sent off my letter to HSBC asking them to repay all default charges totalling £1378 and asking for a full response within 14 days.
However I've not had a 'full response' I received a letter advising me they are looking into the matter raised and will contact me with a full response as soon as they have completed investigations. They also enclosed a leaflet called 'listening to your comments'.
I'm unsure what to do next, should I stick to my 14 days demand timetable and write again demanding they pay up or I'll begin court procedures. Or should i wait a little longer for them to come back to me with their comments? Its now been 16 days since I last sent my initial letter so I know I need to decide what to do quickly.
Thanks for any help!
Send
2nd letter giving another 14days to refund the money or you will proceed through the courts with no further warnings. Thats what i did.0 -
Bank: Halifax
Amount Reclaimed: £6,476
Amount they paid ????
The story - Thanks to this site - sent pro-forma letter requesting charge details on 23rd March 2007. Got no reply so reported to ICO (as instructed on the site) and dropped a letter of complaint at my branch - attaching a copy of the original request and letter to ICO - still nothing from Halifax.
Phoned customer relations of Halifax today (8th May) long wait for answer but very friendly reception. Checked my closed account details and stated £6,476 in charges over the last 6 years.
Went on to say that they will put the claim for the refund in for me and there was no need for the refund claim letter as they were trying to fast track the claims without having to shufflr loads of paperwork - he gave me his full name and the claim reference number - stated would send a copy of my charges out in the evening post and that I will get an acknowledgement of my claim within 5 working days.
Also said they had been allowed up to 8 weeks to make their decission.
This is an interesting one because it is over the £5,000 small claims maximum - Also said that the £10 cheque fee that I had sent had not been cashed - so I could cancel it if I wished.
WORTH TRYING - Phone Halifax customer relations on 08457 25 35 19 and follow the instructions for claiming bank charges back - be prepared to wait - I waited about 25 minutes for an answer - give them your bank details and they will tell you within a couple of minutes what your charges are, post a copy to you and start your claim for you - no letter to send - no £10 fee to pay, no 40 days waiting for response. This could fast track your claim and see you paid out sooner.

Thanks kevslegs and Cyberman - I will send a second letter giving them a further 14 days.
Should I increase the amount by the £103 in this second letter - or do you think this will just confuse them?!!
In which case, should I wait until this initial claim has been resolved (fingers crossed!) and then start a second claim?
I'm torn as I don't want to ruin my first claim and risk not getting nearly £900 but at the same time, I don't want to lose this final charge of £103.0 -
thanks
also we have more than one bank account with nat west. would you deal with all accounts at once or one at a time?
as they are all overdrawn
thanks Ann0 -

You could say that on the (date) you applied a further charge of £103 which I do not accept. Either you refund this immediately or I will add the amout to my total claim against youThe Winner Takes it All0 -
Oh dammit.
I just checked my Acknowledgement of service ( 28days up in a few) and noticed that i'd put the defendant as "HSBC BANK PLC THE MANAGER". D'oh.
Now i'm gonna have to apply to the court and change it to just the bank name. I put the manager on when I went through the hmcol stuff as the person to send the paperwork. What a wally.
This will no doubt delay things0
