  • Hi this is my first thread. I have followed martins guidance and gone through the whole proceedure to reclaim £5621 from first direct including interest and court fees. I have been re assigned to my lopca county court and have just been sent an order giving various directions, what do i do now?. What is the best way to do it.? Don't mind admitting getting a bit jittery now

    Hi Everyone
    We have just wrote letter 2 to Barclays and have given them 14 days to respond. We recieved a very polite letter the weekend stating that they need a further 4 weeks to look into our complaint to fully investigate it, they also state if they cannot do it in 4 weeks they will let us know and give us a full report in 8 weeks. Has anyone else had this? Is this a typical stalling method? Do you think we should now continue to letter 3 taking court action?
    Any advice would be great. Thankyou and good luck to all in the same position as us.

    Typical stalling method being used here ... send your final letter threatening court action. Just make sure you keep to within all the timescales and you'll be fine.icon7.gif

    Hi

    I have sent the two prelim letters to my bank (Clydesdale).
    I got a response from the first one int the time scale of 14 days, But havnt heard a peep from the second.
    So am now going to start the court proceedings.
    i am claiming £2700, but i am in scotland and the upper limit for a small claims court is £750.
    How do i proceed?

    Can anybody tell me, if I sent the 2nd letter with the list of charges on the 26th April, when I should actually send the next step letter. DO I have to wait 14 days before typing and dating etc.

    How long is it taking people to actually get thier charges back? Do they just put it in to your account or do they send a letter offering a settlement amount?

    Hi Minchkins, The problem is that in England you can only claim up to £5000 in County Court. Have you claimed the full amount and DOES IT INCLUDE THE INTEREST. What directions have you been given ????

    but in view of the amount of your claim and the fact you are dealing with the Clydesdale I would recommend you ask the Financial Ombudsman to take on your claim.
