    One case that went to court, and some do, the lady won her bank charges but lost her case for compensation.

    I had had a bad day with the bank when I fired off that post and was feeling fiesty. I have to say I am am feeling so miffed with them I am now thinking just getting the charges back, while some solace, feels like they are getting off easy considering the anguish they have put myself and others through.
    Should be realistic though, I guess.

    Sorry if I have been a bit over the top these past few days. I'll be quiet now :o

    For those of you who remember the 60's you will also remember Peter Rackman.
    Peter Rackman was a notorious landlord in the sixties, he saw an opportunity to make money out of housing Imigrants when nobody else would house them. He evicted all of his existing tenants and replaced them with Imigrants. Conditions were disgusting he didn't keep the properties in good condition and took advantage of his tenants as no one else would house them, he charged high rents and sent in 'heavies' to collect rent.

    Laws were quickly introduced to stop this ever happening again.

    It seems those Rackman days are back heavily disguised as a professional and ethical business !!!!!!

    Right now, the current process can be considered as the start of a tidal wave, BUT, it will very quickly build to a full scale Tsunami and the worry is, will the banks have enough staff to cope, will the court system be over run
    by banks wasting valuable court time ?


    While proceeding with my claim with Natwest, I have lodged a formal complaint as to other dealings with them. One of the questions I have asked to be answered is 'As a result of illegal charges levied on my account is not only immoral to advise I increase my overdraft to cover these illegal charges but also then illegal to make profit in interest from the increased overdraft?'

    I am about to send a letter to the FO requesting assistance in my claim against Natwest and would really appreciate it if anyone has the time or inclination to scan over the letter and see if I am going in the right direction.

    Well just added up my interest on the total and from £4131 it now comes to £5366 wow thats a difference.

    I just called Bank Of Scotland (for the 3rd time) to find out why I have not recieved statements.

    I went into my branch on March 20th to request statements from 2002-2005, I recieved statements from 2004-2005 a few days later (which was pleasing) and to date I have still not recieved any more.

    When I sopke to them tonight, I was told that the statemtnts can take up to 9 WEEKS for this information!!

    Can they Do this? does this not go against the 40 day rule?

    I have requested them again, so heres waiting...

    (however my friend requested hers last week and yesterday 10 envelopes arrived, funny that)

    Help please!!!!

    HI, can anyone help me out. I have just received a letter from Amex telling me that because i was unhappy with their first response they have escalated my complaint and and will contact me when they have investigated. They have given no timescale. Do I progress to court or wait a bit.

    Hi I’m trying to claim back late payments of Sterling Credit, this is a loan I had out a few years ago and has been paid back in full. I sent my first letter of 05/04/07 form my default charges received them 24/04/07, I then sent my second letter of 24/04/07 asking for £272.76, this is the letter they sent back 02/05/07, what should I do next, can i claim this money?

    Thank you for your recent contact informing me of your complaint. I am concerned to learn that you are unhappy with Sterling Credit Ltd and the administration costs debited to your account.

    I have taken this opportunity to review the background of your complaint and have given careful consideration to the comments you have made and all of the information available to me. Having completed my investigation , I am unable to uphold your complaint and have summarised below the basis on which I have reached this decision and hope that my explanation clarifies matters.

    Default charges are charges payable if customers do not make the required minimum payment by the due date, if they exceed their credit limit, or if, payment is not made on time, or is returned unpaid. The amount of these charges, and the circumstances in which they are applied, is set out in clause 6 of the terms and conditions of the agreement and the customer tariff of charges sent to you from time to time as revised. We believe that Sterling Credit Ltd's charges to customers are fair and reasonable.

    In April 2006 the OFT published the findings from it's enquiry into default charges payable in respect of credit card accounts. Sterling Credit Ltd has carefully considered the OFT's publication but does not accept the principle that its findings apply to your type of account. Accordingly, I regret that we are not prepared to make any refund of the default charges payable or provide any compensation.

    It is important that your issues are fully addressed. Therefore, if you have any further queries relating to this matter, or remain dissatisfied, place do not hesitate to contact me and I will arrange for your complaint to be escalated. Alternatively, you may follow the steps detailed on our internal complaint procedure, I would also like to advise you that unless I hear from you within the next 8 weeks, I will assume the matter is resolved to your satisfaction and my files will be closed.

    You need to calculate the interest on each individual charge using the Interest Calculator in Martin's article. This will give you a print out to send the back and make sure you do copies as this will form your defence should it get to court.

    The banks would have classed the charges as revenue, and so this would, along with the rest of their revenue have been subject to corporation tax after expenditure. Therefore any refunds given to the consumers would actually benefit the banks in a small way since they will pay less corporation tax next time due to the fact that the refunded charges will hit their profits. So actually they aren't defrauding the taxman (although I'm sure they try to maximise as many loopholes as possible... :rolleyes: )
  • I have been slogging away at this for months and Lloyds seem to be masters at stalling. I issued a summons and a Notice of Acknowledgement has now been filed, saying they are going to defend the claim. Has anyone else had this with Lloyds? It's all a bit scary and they have moved it to Northampton and I filed it in Guldford. I read somewhere if it does go to Court you can apply as an individual to have the hearing in a place suitable for you.

    I would appreciate any advice or encouragement you can give!
