Hi i was wondering if someone could help.
I posted a letter requesting a full refund together with a breakdown of my charges to my bank on 30/04/07, and had recieved a reply on the 2/05/07 (wow how quick was that!!) stateing they were looking into it and that i would have a further reply within four weeks.
However i am due to have a futher £90 bank charges go out of my account this week after finding out that the balance that shows on your online banking statement is not a true statement of your account ( why they bother putting a statement thats available online then i have no idea) Anyway, how should i go about claiming these charges back, can i claim them ontop of my already submitted claim or should i wait and ask for it later once the claim has been compleated.
I have to say so far Halifax have been nothing but accomidating after i requested my statements from my bank i recieved them within 7 days, i then had to request them again as i thought i had been with the bank longer than the amount of years of statements they had sent me, again they sent me my statements within 7 days and did not charge me.
Therefore i am allowing them the four weeks that they have requested to deal with my claim, however i am a little worried that i may be being too nice.
I am reclaiming £2332 for the last 2 1/2 years ( most of that occured during my college years).
Any help would be appreciated

They have 40 days to provide this. If they don't the next step is reporting them to the Financial Ombudsman.

However, while this is good in principle, I am now exploring the avenue of exemplary and aggravated damages for the way in which Natwest has 'managed' my account.
I am looking particularly at 'aggravated' damages, as the manner in which Natwest has acted (or inacted) has caused mental distress to to myself and those that post on this forum. Aggravated damages pertain to compensatory recourse rather than punative as with exempary damage.
One case that went to court, and some do, the lady won her bank charges but lost her case for compensation.0 -

Out of interest, how long did First Direct take to send out your statements to you. I am still waiting although their 40 days are not up yet, but would like to know what to expect.
When did they make you an offer?
I'm sure if you read through the boards, this is just procedure, these banks like to take it to the wire. Good luck.

19 Feb Sent claim to First Direct
6 March received offer
10 March Sent letter asking for full amount or court action
23 March Filed claim with MCOL
2 April FD intend to defend
24 April FD filed defence,
1 May Claim transferred to Bournemouth County Court (no questionnaire required)0 -

Hi all - am in the process of asking Lloyds TSB for £789.00 - sent 1st letter and received a long reply basically saying that I had agreed to these charges, I have now sent the 2nd letter and am waiting for reply. Can anyone tell me if any of the banks have actually gone to court to - I am beginning to feel a little nervous.0

I am about to process a claim with the small claims court, but Im not sure of which address to use, shall I put the address of my where my account is held, or do I put the address of where I received my letter saying they were investigating the matter, which was sent from the Service Quality Team? Can anyone help me with this please? Im ready to take this to court now, a little nervous as Ive never done anything like this, but I am not going to give up!

amount being reclaimed 1999.50 + 120 bank charges + 8% interest.
I sent the first letter on 24/03/07. got letter back claiming they would look into my claim and that they had up to 8weeks to look into it. sent another letter stating that if they did not respond i would be taking them to court. they did not respond. Put in a claim on money claim. I received a letter from the courts saying that HSBC had received my claim and that they have said they will defend it in court i am awaiting further instructions from the courts. Wish me luck.

i have just sent my 3rd letter giving them 14 days to return my charges or i will start court preceedings.

Nevertheless, just write back and quote:-
""The law is plain: any charges banks levy on their customers must be proportional to the actual costs.""
So, ask them for a full breakdown and to justify in writing to you.
