Hi everyone,
just a quick question, I'm in the midst of re-claiming....got the bank statements from Barclays then sent the first letter requesting money back.
They then sent me a letter from their 'Retail Banking Customer Relations' Dept in April saying they are investigating and will get back to me before May 4th, sure enough on 3rd May they sent another letter saying their investigation is continuing and they now need to collate more information and will reply by June 5th!
Is this just a standard stalling tactic? as surly I have collated the information about what they charged me from the statements they sent me, so what do they have to collate???
Should I wait until the reply or just go ahead and issue court papers now?
What a lot of rubbish. If you have received the statements, they have the same records so what is there to investigate. Sounds like Barclays have inadequate administration. Just go ahead and issue the court papers.The Winner Takes it All0 -

Just a few years ago, before such great sites as Money Saving Expert, everyone was on their own when it came to fighting the banks.
The banks had it all their own way but that has NOW changed.
No doubt the banks now look at this site everyday and they can see the power of their customers building to great heights. There will be no end to the attack on banks as more and more innocent people discover the way forward and get their money back.
It seems that all banks are trying to use the same scare tactics and it does pose a question .... is there a CARTEL running ??? A Cartel is where a group of like minded people or businesses join together and is highly illegal.
For those of you who remember the 60's you will also remember Peter Rackman.
Peter Rackman was a notorious landlord in the sixties, he saw an opportunity to make money out of housing Imigrants when nobody else would house them. He evicted all of his existing tenants and replaced them with Imigrants. Conditions were disgusting he didn't keep the properties in good condition and took advantage of his tenants as no one else would house them, he charged high rents and sent in 'heavies' to collect rent.
Laws were quickly introduced to stop this ever happening again.

It seems those Rackman days are back heavily disguised as a professional and ethical business !!!!!!
Right now, the current process can be considered as the start of a tidal wave, BUT, it will very quickly build to a full scale Tsunami and the worry is, will the banks have enough staff to cope, will the court system be over run

the thing that worries me is that they ask me to prove why it is unlawful (including the law that says it is), and why it is unfair. I am confused, do I need to find these law references, I am not even aware any such things exist, and am getting really worried now. I would really appreciate anyone's help or advice on this matter. Thanks x
The law is plain: any charges banks levy on their customers must be proportional to the actual costs
Penalties which make profits are unenforceable at Common law and The Unfair Terms in Consumer Contracts regulations 1999
The two go together. Suggest you ask them to provide you with information as to their belief of common law and most importantly why THEY think their charges are legal IE: Ask for a full breakdown of how they arrive at their charges.
They will not do this just as much as they will not go to court and tell a judge the same.
They are trying to confuse you with Jargon

HI, I'm sorry if I sound a bit thick but I'm still confused about overdraft charges.
The majority charges in my claim are overdraft fees and excess overdraft fees. Can I claim for both of these fees?
I've sent all the letters off and received response back from First Direct to say that they believe there's nothing wrong with their charges and now I'm unsure of my next step. If I go ahead with starting a small claims on-line should I take the standard overdraft fees off? Did I OK these fees when I opened the account, it is noted in their terms of conditions that they'll charge but each time is between £25 and £30 each time.
Is my claim likely to be unsuscessful if these charges are included?

Hi, If you have an overdraft and stay within it's limit, the banks are entitled to charge standard overdraft fees as you are borrowing money.
However, if you exceed your overdraft and they bounce a cheque or Direct Debit because you are over your limit, they will place an unfair penalty charge of say £35. It is these unfair penalty charges that you can claim back.The Winner Takes it All0 -

Suggest you do not mention the standard OD fees as this will give the bank a reason to reject your claim as they will ignore your genuine claim

I am currently waiting for a court date as Shabby have decided to take this further. I intially asked just for my bank charges back which in total is £4131 but reading thought all the threads i wondered if now its going to court i could add on my interest. Also would i calculate that every month for the bank charges i have had ie 2000 jan 35 charge 14 interest
