    Sounds Good,

    Whilst the banks are drinking champagne,smoking havanas and announcing record profits, the rest of us are left wondering what the hell to do.

    Thank goodness for modern day Robin Hoods who help us fight fire with fire.

    Banks must be made accountable for their actions, which have inflicted misery and hardship on thousands and thousands of people.

    It has to be worth a go and if it proves fruitful, we could be heading for ANOTHER landslide of claims

    Hi everyone,

    just a quick question, I'm in the midst of re-claiming....got the bank statements from Barclays then sent the first letter requesting money back.

    They then sent me a letter from their 'Retail Banking Customer Relations' Dept in April saying they are investigating and will get back to me before May 4th, sure enough on 3rd May they sent another letter saying their investigation is continuing and they now need to collate more information and will reply by June 5th!

    Is this just a standard stalling tactic? as surly I have collated the information about what they charged me from the statements they sent me, so what do they have to collate???

    Should I wait until the reply or just go ahead and issue court papers now?

    Move on with 3rd letter. Email and phone them. Get a reference number and a name. And mention the Financial Ombudsman.

    It is YOUR timetable not theirs.

    I have to say that part of legal discourse is the validity and weight given by Courts pertaining to 'the wrongdoer's conduct has affected a large number of people and so caused a large number of claims to be made in respect of it'.

    I think the number of posts on this site equate to a large number of people being affected.

    I would like to know if others feel it might be worth a shot to rally on this one.

  • Hello Can any one help me we wrote to the Halifax on the 20th March 2007 and we sent the £ 10.00 Cheque requesting the statements for the last 6 years regarding the unfair charges for over drafts etc but we have not recieved any statements back and now its the 5th May 2007,
    What do we do ??

    They have 40 days to provide this. If they don't the next step is reporting them to the Financial Ombudsman.

    Can they take the 40 days from the date they get the cheque/p.o? Or can you claim it from the date of the letter? I sent the letter first as some charge and some do not - and those that do - do not all charge the same. So a difference in dates?

    Also can you claim the 14 days from the date of the letter and not the date they claim to receive the letter?
  • when i first wrote to abbey asking for my statements i also told them i intended claiming my bank charges back from them. i recieved my statements and then wrote to them asking for my charges back.(no reply)
    i have just sent my 3rd letter giving them 14 days to return my charges or i will start court preceedings.
    i have now recieved a letter off them, regarding my first letter to them (when i asked for my statements) saying their charges are justified and if i dont agree with them i have 8 weeks to write to them and complain, after that they will close my case.
    should i write to them and complain or ignore the letter, wait one more week untill the 14 days are up and then start court proceedings.

    Thanks Leaf, thought that would be the answer, but just thought I would ask the question, they must giggle as they send them letters out thinking if we keep this up the sap will just give up eventually!!

    Bank: First Direct
    Amount claimed £1436 plus interest = £1587.56
    Amount offered £1220 - holding out for full amount

    I'm claiming for my son, I filed a claim with MCOL and he has just received a 'Notice of Transfer of Procceedings' FD waited until the 28th day to file their defence! So I guess we now we wait to hear from Bournemouth County Court with a date. Can someone who has gone this far with First Direct let us know what to expect next?
    Do I need to do anything and should we expect to hear from FD's solicitors? Will they wait until the day before the court date before offering the total amount?
