just got letter today from nationwide saying that they do not agree to my charges being refunded. They only refund in exceptional circumstances also said that at the time when we opened our account we agreed to abide by the terms and conditions! the charges were £530 over six years do relise that they mainly due to insufficient funds or one charge coming out then being charged for not having money in to cover another direct debit because they took theirs, should i except this or send them the next letter taking them to court as was relying on that money coming through. PLEASE SOMEONE HELP, the thought of going to court scares me have not been there before!!!!
The thought of going to court scares everyone, however rarely it goes that far. I had a claim on going against Nat West whom I took to the small claims court , had a judgement by default made against them,and continued with a Warrant from my local court to instruct the Bailiffs to recover the debt.
Upon the warrant being issued Nat West paid in full.
Remember that if the Banks wanted to defend they would , it very much appears that they will not defend in court as if they lost it would set a precedent for all to claim and not just the so called brave:

after sending first two letters bank has now advised that they will not refund charges and advise of my right to refer complaint to the financial ombudsman service. is this the next step or should i now refer to the small claims court, also, as the bank is in england but i live in scotland which small claims should i use
Have a read of the Reclaiming in Scotland for the various options about going to court or not. If you decide on court its your local Sheriff Court

Hi, this has probably been asked before but with 150+ pages it would take a fair while to find the answer.
Does my claim start from the date of the banks acknowledgement of my complaint?
Reason being it has taken some time to get my statements and I know there is a large chunk of charges 6 years ago between Feb and May.

After successfully reclaimimg bank charges my question is can I do the same for any late payment fees added to a loan as well, and if so does this cover loan companies as well as banks.

The post you quoted was in reference to a post made back in November about what the bank would deem fair. In fact the banks and cc companies will claim that £12 is fair and that they are allowed to charge you this etc however, yes you can claim for these charges.0 -
Hi everyone, sorry if I am in the wrong place, I am new to this, and am not quite sure how it all works. I wondered if anyone could help??? I first asked fro statements at beginning of Feb this year, got them exactly 40days later. Sent the first, then second letter, no reply. Then I used MCOL nad paid the £80 (that was beginning of April) I got a defense approx two weks later, so waited another 14 days. Now I jhave a letter from Natwest solicitor to defend and ask for more information, which I do not understand. This defence was done on 23rd April, and the bank's solicitor gave me 14 days to reply, or they would request the claim to be discontinued (if I didn't reply) I have been waiting for a letter from a court with an allocation questionaire, but not received anything. I have just phone MCOL who informed me that it had been referred to Doncaster County Court, but that the courts no longer issued the questionaire. I rang the court and they told me they couldn't offer any advice as they are neutral but that the Judge would look at it and write to tell me what happens next. It is just that the 14 days the bank has given me runs out on the 7th of April, yet I wont have heard from the court until around the 11th...so will my claim be discontinued. I seem to have been waiting forever for something to happen, and am now worried that It will all have been a waste of time. I cannot reply to the bank's solicitor letter myself as it is all legal jargon and wouldn't have a clue on how to respond. I am sorry to have gone on and on, am just very worried, and very confused. I would very much appreciate anyone's advice on what to do next. Thank you0
