    Hope I am in the right place this is the first time I have posted on this site. I am claiming 6 years late payment charges from American Express. I had a letter today acknowledging receipt of my second letter and saying that because I was disatisfied with their initial response my complaint has been escalated and will be investigated futher. Do I wait , if so how long. I am wondering if this is genuine or a delaying tactic. Some advice would be appreciated.

    just wondering if any one can help me, i have just send my secound letter off to halifax asking for all my charges back, but im a bit worried, i have been to a few bank asking to open a new account, but with a bad credit history and no passport or driveing licence i cant seem to get one, does anybody no where i can go? please any help much apprciated.

    Halifax did'nt close my two accounts after i claimed nearly £2,000 so i would'nt worry too much about getting another account.

    Not only that, they have let me upgrade my account from basic cardcash to current account with cheque book and £100 guarantee card. So i'm going to be managing my account better from now on.

    i sent off our reclaim letter through the bank and was told it would take up to 40 days, do i wait or send the second letter on the 2 week alloted time i stated in my letter?

    Absolutely without question, stick to your time limits not theirs. You are the one in charge. Letter 2 giving fourteen days before court action, and then court if you don`t receive a satisfactory conclusion. Good luck x

    after sending first two letters bank has now advised that they will not refund charges and advise of my right to refer complaint to the financial ombudsman service. is this the next step or should i now refer to the small claims court, also, as the bank is in england but i live in scotland which small claims should i use

    I went into my Bank Of Scotland branch around 8-9 WEEKS ago, to requst my statements from October 2002 to July 2005 (when I closed the account) Lady advised that it would take up to 40 days, and didnt charge me.

    couple of weeks later, I revieved 1 statement, from Feb 2004-July 2005, great! However, thats where it stopped. I then called them to request them again (about 5-6 weeks ago) and was told they were on their way.

    After still recieving nothing, I called again, The girl was really helpful and said that their policy had changed and that they can request all charges to be sent in an email to their back office, and to wait up to 4 weeks. (That was 2 weeks ago and still have nothing)

    Because i never sent the templated letter with a £10 cheque, where do I stand with this? Im getting really impatient as I want my charges back!!!!

    grrrr.

    Any help would be much appreciated.

    If you are being charged EXTRA charges on top of the illegal charges of £35, then tell your bank the following:-

    It appears that you are applying penalty charges because you have applied illegal charges which then created a false balance which shows that I have exceeded by overdraft limit.

    At no time have I agreed that such charges can be taken from my account and permission to do so is denied.

    May I remind you that the law is plain: any charges banks levy on their customers must be proportional to the actual costs.

    Clearly £35 is not proportional to your costs and therefore I request you provide me with a complete breakdown of how you arrive at £35.00

    In the meantime, please be advised that I will not accept such charges being applied to my account.

    They are trying to fob you off. Go for the kill, issue a summons, that simple
