Claim for bank charges has now been transferred to local court as Abbey have put in a defence. Copy which I have now received. Has anyone else got to this stage.....Any advice would be great to calm my nerves a little.

Please could someone help?
I sent off my request for statements by recorded delivery on march 7th.
I have not recieved anything yet (and by my counting the 40 days were up today, 3rd may)
I called them on May 1st to ask if they had recieved it, I was told thatthey recieved it on the 14th April and have 40 days from then to respond.
I checked my recorded delivery code with Royal Mail which says that it was recieved on March 8th.
Where do I go from here? should I call up Barclays and complain again before contacting the information commisioner?
When does the 40 days actually start from? the date i send? the date it's recieved?
What do I actually have to say to the information commissioner?
Ask the Post Office for a copy of the signed receipt and tell Barclays you have proof of delivery as at the 8th March. Remind them that the 40 day
period as required under the Data Protection Act has now expired and you therefore expect the information by return of post failing which you will issue a complaint to the Information Commissioner. Barclays are now acting illegally and you must point this out to them.

That's what Abbey want to do ... scare you. What defence do they have ? Are they going to explain to the court the breakdown of their illegal charges, hardly think so because it will open the doors for EVERY Abbey customer and indeed every bank to repay the charges. Abbey will settle beforehand. As we know already, nobody knows of any bank appearing in court. Shame on Abbey, it's forums like these that show people who not to bank with.The Winner Takes it All0 -

"Without Prejudice" offers to RBS are not dealt with any quicker than others so you may as well go for the full amount. They will still take the full 8 weeks to make an offer and it will take them a further 10 days for them to pay up if you accept.
Is there any way of getting these types of claims looked at earlier as it is in the tnterest of both parties to do so?0 -

I read it in the Manchester Evening News but if I recall correctly, the article did not go into the reasoning behind the decision, just that the lady had beat the Bank. It might be worth having a look on the web... it was in March I think.
