just wondering if any one can help me, i have just send my secound letter off to halifax asking for all my charges back, but im a bit worried, i have been to a few bank asking to open a new account, but with a bad credit history and no passport or driveing licence i cant seem to get one, does anybody no where i can go? please any help much apprciated.0

Hi racool, I too am from Scotland and my claim is for well over the £750. small claims limit. I am also with the BOS and my situation was very similar to yours. eg. having an o/d and paying charges for exceeding it, which made the balance even higher and getting more charges and so on...

just got letter today from nationwide saying that they do not agree to my charges being refunded. They only refund in exceptional circumstances also said that at the time when we opened our account we agreed to abide by the terms and conditions! the charges were £530 over six years do relise that they mainly due to insufficient funds or one charge coming out then being charged for not having money in to cover another direct debit because they took theirs, should i except this or send them the next letter taking them to court as was relying on that money coming through. PLEASE SOMEONE HELP, the thought of going to court scares me have not been there before!!!!0

You have two options: Refuse the cheque and send it back, saying you are not prepared to accept anything less than the full amount + court costs.
Or you could bank the cheque and send them a letter like this:
"I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges + statutory interest + court fee."
In this case you will need to inform the court that part of the claim has been paid, and amend the amount you are now claiming for. I am not sure what that entitles though.

Send them the next letter and press on. The charges are unlawful and the banks know it.
This will not get to court. The banks do not want to set a precedent in law because it will then be even easier for people to get their money back.

hi just wondered if anyone could help me barclays have full mount £480.00 after 1 letter they state that this is in full and final settlement. does this mean in future we could no claim again?0

I sent a request to M.B.N.A for my bank charges totalling £500. Then L.B.A . Due to file court claim this coming weekend, but something odd has happened!! I received a letter from M.B.N.A this morning saying thanks for asking for a list of all your charges (i hadn`t as already had statements), they total £716 pounds. Do i have to start at the beginning again? i don`t want to lose the extra money. Can anyone advise please? thanks x

Can some one who have used Martins interest calculator succesfully please explain it to me: example bank charged £56 on 31/05/2001 calculator reads:
interest -£10.8 total to claim ££45.2.
I would have expected calculator to show charge £56 + interest ie giving a total figure larger than £56.
any explaination.

Just input your £56 into the calculator and it shows interest at £26.56 = total of £82.56.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0
